When my fiance came off of a 8 year active duty stint in the United States Coast Guard, he had a difficult time finding a job (like many veterans). Finally, a year and a half of being unemployed came to an end, as he was offered a job; unfortunately this job ended-up being 2 hours from our home. Rewind to the origin of the issue:

WF overestimated (doubled!) our taxes. Of course, we submitted a letter from our tax accessor stating that taxes hadn't changed, but in true WF fashion, it took them 5 months to correct this issue. Until the issue was corrected, we were charged late fees for "partial" payments, that were actually correct full payments. It was at this time that we began to receive letters stating that because my fiance is a veteran and he had a VA loan, he had a myriad of payment options. This just happened to coincide with us needing to move, rent a house and continue paying the mortgage (paying for two homes!) So, my fiance called WF and they explained all of the details of a one-time payment waiver/deferral, which would increase his subsequent 6 payments by $500 (he finished paying this plan 2 months early.)

Well- wouldn't you know it, WF NEVER waived a single payment for him. They simply applied each payment made to the previous month. So, when it came time to make what he thought was the January payment on January 9th (within his 15 day grace period), WF decided to mark his PERFECT credit with a 30 day late delinquency.

I've written a registered letter to the "Office of Executive Disputes." I've written a registered letter and email to Mike Heid, President of WF Home Mortgage, I've written a registered letter and email to John Stumpf, CEO and President of WF and I've played phone tag and fought with 2 different young ladies in their "Executive" Customer Service division. They've all done the exact same thing- NOTHING.

Wells Fargo clearly mislead my fiance with their mailings preying on young veterans in need of actual payment assistance. Wells Fargo further intentionally left out critical details of their "payment arrangements" saying that they were waiving a payment, which apparently was never part of the arrangement. Thoughtless, careless and reckless- SHAME on you, Wells Fargo. A soon-to-be married couple with an income in the mid-six figures, both with credit scores in the high 600's, one being a veteran, still active in the reserves and continuing his service as a law enforcement officer who cannot get approved for a mortgage at the highest rate because of YOUR dishonesty.

Back in June of 2013 I requested a loan modification with my loan company Wells Fargo. I received notification from the company to start the process of the modification such as processing my financial data. I submitted everything and was told I needed to be under a trial period of 3-months before an approval can be given. That I needed to secure 3 monthly payments in the amount of 598.75 for the months of Aug., Sept. and Oct of 2013. I secured all 3 payments through my checking account and each payment was to be drawn on the 4th of each month. I made my first payment in July which I was told would go towards my Aug. payment. After the end of the trial I received a set of loan modification documents which I needed to have signed and notarized. There was a deadline date of "15 business days from the date" of the letter. There was also a modification payment date of Dec. 1, 2013. I submitted all of the documentation before the deadline and I was waiting to receive some form of notification of approval. However, I received a phone call from my Home Perservance Specialist, Ms. Sandra Morgan notifying me that there had been an error on the loan documentation on their part. She explained that they had a "typo" and put in the incorrect maturity date. She then explained that another set of documents would be coming to me and all I would have to do is sign and have them notarized again. She promised it was an easy process and it would only take a few days to get the docs. out to me. That was Nov. 2013, she also wanted me to know that the new modification payment date would change to 2/1/2014 in the amount of $598.75. Time had passed by and I wondered why I had never received the documents.

As the holidays passed I decided to call Ms. Morgan. I finally got a call back after a dozen messages being left close to the end of Jan. (around the 24th). She mentioned them being back-logged and that was the reason for the delay. She assured me the docs was on their way and she reminded me of the upcoming payment. I did receive the documentation and it did have a 2/1/14 payment date. I made the payment for the 2/1/14 date. I sent the package back. Approximately two-three weeks later I was notified that the documents contained an error and that another set would be sent to me. This was around Feb. 2014. After signing and having the forms notarized again. Around March 2014 I received a phone call stating the documents were not properly notarized and a new set will be coming back to me. At this point I explained to Ms. Morgan that the notary refused to notarize a blank form. I also assured her the form that was blank was NOT attesting to my signature. However, the blank form was for Wells Fargo to complete and have notarized. By now Ms. Morgan is yelling and screaming at me and she insisted that I no longer take the forms to another notary but I HAD to take it to a Wells Fargo branch because, "they know our forms". When the 5th set of dcouments came in March of 2014 I did just as she asked (keep in mind myself and my husband have been taking off of work early to get this done---EACH TIME).

We took the package to a Wells fargo branch where the lady at the branch location refused to notarized a BLANK form. My husband already upset started yelling and screaming and the Branch Manager came over to assist. Basically, she notarized the forms, gave me her card, took down the email address and phone number to Ms. Morgan and sent us on our way. Within a week a recieved a call stating the docs. were REJECTED AGAIN and that set #6 was on its way. It seem that the notary was not supposed to notarize that BLANK form after all. Now we are into April and we took set #6 back to the same branch. She DID NOT notarize the form. She called Ms. Morgan to clear instructions on what was needed. After following through I contacted Wells Fargo and spoke to one of the customer service employee. I explained to her that I did not want to send the docs back without knowing what I am doing wrong. The lady had me to fax the docs in for her and Ms. Morgan to look over. She stated once they reviewed it if there were any errors they would inform me what they were so I can go back and correct them. I followed through and faxed the docs. to them. They contacted me explaining what needed to be done and once I fixed those errors I could send the package in. After mailing the docs. off about a week later I received a call from Ms. Morgan stating they were REJECTED again due to an error on the notary part. She put in the wrong date. Therefore, set #7 was on its way. I received set #7 took it to another notary...made sure he dated it properly. Made sure we signed it properly while all along still making my payments $598.75. After sending the docs. back out the blue I received package # 8. I have not taken it to a notary nor had I signed it. This has been going on since June of 2013. With all the back and forth, leaving work, taking off early my husband was terminated from his job due to abandonment. I need some legal help badly.

I went to my home mortagage company in March. 2013 to seek assistance on my mortgage payments. We had a death in my family and I had to fly myself and my four children back to California to bury my ex-husband, their dad.

Upon my return I contacted Wells Fargo and explained I needed assistance because I had fallen behind on my payments. i was working as a teacher at the time making only $18.00 an hour. I sent in a payment of $1394.00 on March 24, 2013. However, I was still behind. It was then that I was referred to speak to a Home Perservation Specialist. I started working with this person around June/July 2013. I was placed on a trial payment system for 3 months. I was to make 3 consectutive payments with no missed payments to qualify for the program. I made those payments as scheduled. I set up the payments to come directly out of my account every 4th day of the month. In addition, I made one payment in advance. So, technically I made four payments. I was contacted that I should receive the loan modification documents by Oct. 2013 making my first payment become due in Jan. 2014. I received the documents and the first payment was due Feb. 2014 (I guess because of that extra payment). After signing the documents and returning them by the due date i assumed all was well. In Jan. 2014 I received a call from Sandra Morgan Home Persevation Specialists stating that the Home Modification documents had the wrong maturity date and that they would need to resend the documents back to me to have signed. I never receieved the documents. I went ahead and made Feb. payment as scheduled. Eventhough the Well fargo representative stated the money would NOT go towards the principal (basically it will sit in an escrow account until this was resolved). I finally got the SECOND set of documents at the end of Feb. 2014. Then a THIRD set in March, a FOURTH set in March, and a FIFTH set in March. All sets being denied because of something that Wells fargo did wrong. As I am still making my payments (not April because I was told the documents needed to be approved) . My new due date was May 1, 2014. At one point I received a call from Ms. Morgan where she yelled, screamed, called me a liar, told me to only go to a Wells Fargo branch to have the documents notarized. I went to the Wells fargo branch on TWO separate occasions and the Notary had no idea what to notarized. Therefore, she gave me her card in order for Ms. Morgan to contact her. After getting document set #5 notarized and signed. i faxed it over to Ms. Moran and another representative just to have them check to make sure everything was OK. They both said the document looked good. After sending the set in I received a call on April 28, 2014 from Ms. Morgan saying the documents were denied because their Wells Fargo Notary, notarized the documents with the wrong date. So, they were sending me document set number SIX. Each set of documents have a March 13, 2014 date which collerlate with doc set number number 3. If these documents were that important and that LEGALLY BINDED I would think the date would make a difference. It clearly states on the documents that I have 15 days from the date of the letter to get these documents signed. Here it is April 29, 2014, 45 days passed what these documents are saying. They are racking up all the finance charges and not paying a dime of my money towards the principal. Somebody PLEASE HELP ME!

To start it has take 5-1/2 years to gather all the facts.

Received a notice from Wells Fargo Home Mortgage of foreclosure in January 2001 after filing for Chapter 13 Bankruptcy, WFHM filed a Proof of Claim that included Legal Fees and Costs, the courts require legal cost to be submitted to the courts seperatly and WFHM applied a 8% interest rate to these fees and costs.

In the BR process WFHM violated the automatic stay and a settlement was reached. A discharge order was given in September 2002 and shortly afterwards received notice from WFHM that the loan was being reinstated as current and removed from foreclosure status. Maintaining the account in a state of foreclosure while in Chapter 13 is also a violation of the automatic stay and probable violation of the discharge order.

In November received notice that I was behind on payments and WFHM issued a demand for an amount that made no sense, in a telephone call to WFHM was told that I had legal fees appearing on my account, ""Advance Corp Transactions - Legal Fees"". Paid the amount stated and requested an account history. Upon reviewing this account history it was obvious that it was going to take a rocket scientist to figure out what WFHM was doing. Two additional account histories were requested in 2004 and 2005, comparing these account histories to the yearly escrow account statements and 1099 the numbers all were different.

The final account history sent to my attorney, note that we were in negotiations with WFHM, directly from WFHM had an entire different set of numbers and this history showed an increase in the principal balance owed had increased by $6,413 with no explanation as to why was noted. Also the attorney in conversing with WFHM received an email that states how they applied payments to ""Advance Corp Transactions"" and ""Suspense"". Be very wary of the suspense account!

It appears as a method where monies can be applied from payments and once there the monies can be disposed of at their will wherever they wish without accountablity to anyone and then claim you missed a payment. Received notice of missed payments and notice of possible foreclosure. Surprise, Wells Fargo Bank,NA instituted foreclosure actions, where did the negotiations with WFHM go, when did Wells Fargo Bank become my service provider.

My CPA has reviewed my bank account and payment history and compare it with mutliple WFHM account histories, remember that that the WFHM histories are all different, and established that all payments were made and in the CPA's opinion was executing an unlawful foreclosure and I have never received a true an acurate accounting of my account. Would suggest that all people request an account history yearly and compare this with the yearly 1099 and escrow review. This is just a highlights of the most serious violations except the one that is where it appears as WFHM has added the cost of the lawsuit they lost to the end of my loan, contempt of court. If I had not had access to an attorney and CPA this would have been a lost battle.
