My husband and I put down an initial payment of $49 each for a season summit pass when we talked with a sale representative while skiing at Breckenridge Resort. About 4 months pater, before paying the fill price, we entered into contact with Vail Results to ask to downgrade our pass to a cheaper one.
I talked to 2 Vail Resorts representatives on the phone about changing the pass. They both told me that we would not be able to down grade to this new pass, and we wouldn't be able to forfeit our deposit. We were very disappointed because we feel that we were given bad information when we made the deposit with a sales representative while skiing at Breckenridge. Apparently, we were misinformed about the following:
1. We could easily change tickets later in the season - other wise we would have logically taken the lowest priced pass with the option to upgrade later. (Phone sales rep said that we can only upgrade not downgrade)
2. We were making a "deposit," which we could forfeit if we didn't carry through with the transaction. I was never aware that we were signing a non-negotiable "contract." I was under the impression that we were simply putting down a deposit on a product - otherwise, we would have never signed it. (This is called free, prior, informed consent, which obviously did not occur in this transaction) (Phone rep said that they would send collections after us if we declined the charge and forfeited our $98 deposit that we made for both of us).
3. The insurance that we bought would ensure that we could have a full refund on our ticket in case that we couldn't use the pass. (The phone rep told us that the insurance means that we still have to complete the full purchase but that we'd have to make a claim to get the rest of our money back - and only certain claims like having an accident- would be considered).
Quite frankly, we felt cheated and scammed. We were expecting to put some money down to ensure that we could have a pass this season, while maintaining high flexibility - as things often change throughout the year. That did NOT appear to be the case. As we had not yet paid the full price for this product, we did not anticipate that it would be a problem to downgrade.
