TBS received a check from a broker for a load I factored for $650.00 and applied to another load I factored for $800.00. They called me and said The $800.00 load was short paid and they would take $200.00 from my next factored load to cover the short pay. I immediately called that broker and asked why they short paid and was told they did not short pay and she was looking at the check copy that was issued. I then called TBS and told them a check was issued for the full amount.
Five days later I received that check and notified TBS as soon as I got it. The next day I got a call from TBS as was told they were going to take the remaining $650.00 from future factored loads because they were told I received the check and did not send it to them. I sent the check to them and still they are taking $200.00 from every factored load. ********DO NOT DO BUSINESS WITH TBS. IF YOU DO YOU GET WHAT YOU DESERVE**********
We entered into a non recourse agreement with TBS Factoring last year to better leverage our net accounts receivables. TBS stated that they would not hold our company liable for any non payment from clients. Come to find out this was not true once we had a client whos invoice was sold to TBS short pay them. They had even gone as far as to release a UCC filing but then turned around and filed another one the following day.
TBS FACTORING will asses huge fines on you for any reason they see fit. They lost a lumper receipt which I had faxed to them and they fined me over $500. When I called TBS I spoke to a lady named JUDY who was very rude and unpleasant.
Judy told me even if I had a fax conformation that says they received the lumper receipt, they still cant find it and perhaps TBS had lost the receipt and they were still going to fine me over $500.
I reminded Judy of the phone call we had a few months ago about the receipt and she KNEW I had faxed it to them.
She also told me that she did not want to carry on the conversation any longer and that she was NOT GOING to carry on the conversation any longer and she was going to fine me anyway, like it or not.
TBS FACTORING LLC will reach into your settlement (paycheck) any time they want and asses huge fines on you. If you deal with this company, be sure to dot every "i" and cross every "t". I have changed factoring companies after getting ripped off by TBS FACTORING..... Bob
