These photograph's were taken in consignment by a photographer, who stayed at our location "in exchange" for the photograph's taken for work to be completed by the Navajo family's. These photograph's were consigned for the family's uranium projects, as impactees, and had no idea that Mr. Storm had intentions to scam them of their phtoography locations.
During the visit the photographer insisted the photograph's would be donated, sole property of the family, and that he had no intent to display or sell the photograph's. Not all of the photograph's were shown to the family and later the photographer posted the photograph's for sale and attempted to unlawfully convert the photography rights of the family to the original co-ownership agreement. The co-owners et.al protest the publication of the photography and have agreed to work out the issues in a Navajo jurisdictional court.
The photography has sacred sites that were not supposed to be posted online or sold. Mr. Storm has issued a statement to cut out the original agreement violating the co-ownership rights of the hosting family.
We have agreed to take the matter into court, however, those threats by Smith aka Storm are just that, excuses to escape the reality of the DCMA accord, which is full accountability to co-owners and their rights to the decision making of what photograph's can be used and how. Example: You can't take wedding photograph's and then publish them for sale without the permission of the contractors of the work.
The photographer has refused to take down the photograph's, continued to sell the photography and continues to deny the rights of the family to the court process by providing a fake "identity". The identity has been found to be false, that Mr. Storm is also known as Steven W. Smith. Misconstrued the purpose of the project and is committing copyright infringement of the works without disclosure to the employers, donors and co-owners of the photography by exclusive geo-location. 5000 photograph's, only 1500 were disclosed to the family. Mr. Storm aka Smith is violating the family's copyright by absconding from the location using illegal acts to unlawfully convert the rights to the family's photography. Family Hosts and co-owners maintain exclusive rights to the photography that was consigned by donation with Steven W. Smith aka Storm the photographer hiree, volunteer for the project.
We strongly caution organizations to get a media agreement in writing before allowing Steven Storm aka Steven W. Smith to conduct your fliers or artwork, as he maintains secret, hidden and exclusive rights in his mind that are not actual law, and will harass you for using the material at any time in the future, if you report him for illegal acts or testify against him. It is our experience as he has engaged us into several Federal Court matters and is abusing the photography of the family in retaliation to prevent them from testifying against him for possible federal charges pending in Oklahoma and Navajo Nation.
