It has been 15 years since they worked at my house (May 1996). Sarkisian Builders were hired to finish my basement. The work included a new furnace (forced water heat conversion from forced hot air) , new bath, toilet, shower and sink (using QuickJon) as well as a fully finished family room, bedroom, laundry room and closets. Part of the job also included a two zone system, so work was also done to plumb the heating pipes for the upstairs of my house.
We have had experienced problems with the ejector off and on (septic smell in cellar at times) and never realized that it was due to the installation not being to code! Chapter 248 CMR.
In summary, the ejector toilet installed in the basement was vented to the air in the septic tank! The code strictly states that the venting is done above the highest drain in the home by 42"". This was clearly not done.I understand that it has been too long (Statute of Limitations) and the wording of the contract (1 year from from workmanship and materials) to be able to recover damages (to be able to sell my home, I just paid a plumber $1200 to undo the job and correctly install the ejector vent piping to the roof) from Small Claims Court, however something must be done to help protect others from being ripped off.

The past client who identifies herself as “granny” called our offices over the weekend when we were closed. We immediately responded to her upon learning of her message with regard to her roof which was installed in 2011. Her message was rude, demanding, and insulting! Her claim of unanswered calls and no return call is false. We also have no record of her claim of calling 13 months after her roofs installation regarding an old sagging gutter that we reinstalled for her after completing the roof. If we had received that call even though it was past the one year warranty period we would have addressed it, as we value our clients and reputation! The gutter was attached correctly one year ago without incident. Most likely the cause of the gutter issue was that it had become clogged and sagged due to a year’s worth of debris. Sarkisian Builders did not reattach the gutter with the middle sagging. She supervised our work on a regular basis with a watchful eye and had the gutter been sagging she would have brought to our attention.
All of the past clients calls to our office, residences and her emails although very rude and insulting were responded to in a very timely manner.
The past client took it upon herself to hire another contractor to address both the gutter and vent pipe boot issues before we even had a chance to evaluate the situations. With regard to the roof, she rudely called insulting our integrity and emailed pictures of the roof after the vent pipe boot was replaced.
Sarkisian Builders installed the vent pipe boot correctly in 2011 and there had been no problems with the boot to this point. After reviewing the pictures that the past client emailed it was clear that the problem that developed during the winter of 2014 (well past the 1 year warranty period) and is a result of backup of ice and snow. The backup of ice and snow occurs when the snow buildup on the roof begins to melt during the day then refreezes when the temperature drops overnight. The thick layers of ice on her roof worked its way up under the vent pipe boot and pushed the boot up allowing water to enter, not an improper installation.
This is a separate issue which has nothing to do with the roof installation that we did back in 2011. Furthermore, I explained this to her when she told me I could claim the damage on my insurance as her high deductible prevents her from claiming the damage on her own insurance. I told her at that time that I would not be claiming any damages on our insurance.
Sarkisian Builders, Inc. did not accept the registered mail package that she sent as we were not claiming the damages. This issue was not pertinent to the roof installation in 2011.
In regard to her previous roof, I clearly remember her explaining that she had an issue with the vent pipe boot and the staining it caused on her ceiling. Having not seen it myself I can only assume that the failure of the vent pipe boot was also due to an ice back up issue as well as the roof itself lasted 15 years.
Lastly, once again her negative comments and her claims of Sarkisian Builders not answering the phone and offering solutions insinuating we are not reputable business are insulting untrue and not welcome!
As a last resort this former client took her case to the Trial Court of Massachusetts District Court Department Small Claims Session and lost. On March 10, 2015 Judgment was ruled in favor of Sarkisian Builders, Inc.
