After reading several Rip Off reports about Pre Trial Litigation, I too found myself with a call from someone named Cal Lindsey or something like that. These guys and gals rely on scare tactics to try and get you to pay a debt. They specialize in On-line Pay day loans and accuse you of writing bad checks which they don't even have. Most online payday lenders use an ACH to a checking or savings account and a draft is never used. Thusly no "bad Check" was ever written. They are loans , not checks. They typically are not licensed in the state they make their loans to. They are not licensed because they either don't qualify or they are trying to approach it from an organized Native American location which they state is not governed by the Federal or State laws.The Supreme Court has not decided upon that yet. This is the only thing they can do to try and collect as their contracts are not inforcable in most states and their approach is completely contrary to The Fair Debt Collection Act. I've asked to speak to one of their attorneys and was denied in the past. I'll end up blocking their phone number if they keep the calls coming.
