We are a Philadelphia Japanese and Chinese food restaurant in Philadelphia, and recently had dealings with a credit card card company named "Payment Systems," a company apparently located in California. When they first approached our business, a sales lady offered us a deal that included only a one-cent fee Per swipe, anod a9% purchase fee. however, as we did business with them, we found out that it was a two cent swipe fee and A 18% interest rate per credit card purchase. Upon calling Payment Systems, we were met with first an excuse "we don't employ the person who sold you that anymore." Upon us requesting that this company take responsibility for the contract, we were met with more excuses and Lies. The issue to this point remains unresolved. Further, even though at first the offer was that we could opt out at any time, they have now insisted that cancellation requires a $5000 fee. Not only is my small business losing money in this deal, I feel we were victimized and taken advantage of. In hindsight, I would not have done business with "Payment Systems" and feel we were a target by this fraudulent company because we are a small business.
This guy/company ripped us off too; promised a lot of hooey that didn't turn out to be true. Unfortunately he bullied a compliant partner into signing the contract that day without reading the fine print. Fees are triple what was promised, did not pay our cancellation fees like he said they would, and the worst penalities we've seen as far as leaving the 4 year processing contract (5 on equipment). Contacted payment systems & they said Rosa was an "independant contractor" and they didn't have any records of him; what a bunch of baloney!

Sales rep fooled us with promises! We cancelled service with our old carrier which we had been with them for over 7 years. They promised us cutting our monthly costs up to more than half. Now that its been alittle over a month noticed my bank account all this charges from them. Called them and they have no explanations at first they told me another rep would contact me. Never received a call from anyone called them twice again and there telling me all there "misc fees" that was never told to us clearly! Now even to cancel they told us is $995 and another rep telling us is non cancellable! Horrible going through this with this company so unprofessional and lying to people! They need to be out of business.
Sales rep came into business represented herself as FirstData employee. Claimed there was no fee for the credit card machine and would pay 0% on Debit and 1% on all other cards. They would save me about $100 dollars amonth based on my current statements. Asked repeatedly how can they do business if not charging for the credit card machine and was told they were looking out for the small business and made their money on the 1% fee. After looking over paperwork again, found out they were charging $89.00 for machine but was told I am not really charged that. Called the next day less than 24 hours to cancel and no one returned my calls. The next day the machine shows up by fedx and within 3 minutes of signing for machine the phone rings and its credit card processing people telling me to plug the machine in so it can be setup, when I refused the rude person on the phone said to bad you are under contract and will pay, when i contacted the so called Sales manager of the Rep who came in person I was told there is no way out and I am stuck. If i couldnt afford the $89.00 a month I surely couldnt afford an attorney to fight this as he was laughing. Said the sales rep told me wrong and he was mad at her but sorry about my luck just pay the fees. I am turning this over to my attorney in the morning. Something needs to be done to stop these scammers or there will be no small businesses left. If a class action lawsuit is set up please contact me. We must stop this now.
On May 4, 2014 I met with a Payment Systems Corp sales representative. I believe his name was Craig Cobb or something similar. He presented a merchant processing offer to me. We discussed what the service offers, and he explained to me that I could save a considerable amount of money by changing over from my current processor, since the fee is only 1% for credit cards, and 0% for debit cards, with a fee of $99 per month for the equipment. As we talked, I explained to him that my current processing company provides the register and card swipe equipment
that I use. He assured me that Payment Systems does the same.
After hearing what he had to offer, I began reading the contract and saw something that made me question if a register was actually part of the offering, for it seemed that the only thing I would be provided is the card swipe equipment. I questioned this, and he said he must have misunderstood, but to let him make a call and see what he could do. He called someone with Payment Systems, and I talked with the gentleman myself. He agreed to transfer $250 into my business account to cover the price of a register, if I would agree to switch over. Craig wrote this information on the paperwork.
As the conversation continued, Craig mentioned that there is a 48 month contract. I explained to him that there is no way I could agree to that kind of a contract, because a large building is going to be constructed directly across the street from my restaurant within the next two years, effectively eliminating my customer parking, and that at that time I will be closing the business. First, he told me that if that happens, I can transfer the service to someone else. I told him I was not interested in doing so. He then told me that I could pay a $200 cancellation fee and that would be the end of it.
Because I didn't see anything about cancellation written anywhere in the paperwork, in fact just the opposite, he again said to let him call his contact with your company, which he did. According to Craig, the gentleman he was talking with said that the cancellation clause Craig was referencing was something Payment Systems did for large companies and would not apply to me. At that point I informed Craig that I did not want to change over if a 48 month lease with no cancellation option was required. He relayed that information to the gentleman on the phone, and according to Craig, the gentleman said, "Let's do a 24 month lease then, and get this done." I agreed and again began reading the contract. I noted in one place that the contract stated a term of 48 months, and I personally changed it to 24 months.
I signed several documents that day, but was not provided copies of any of them. I thought this a bit strange, but I had noted that Wells Fargo was the bank associated with the offering, and I do business with Wells Fargo, so I was not extremely concerned and assumed that copies would be provided from the home office once the paperwork was turned in.
I received the terminal and set it but did not begin using it because I was waiting on the promised transfer of the funds to purchase a register. On May 14, 2014 I received a copy of a contract from Lease Finance Group. As I was filing paperwork a few days later, I flipped through it. Imagine my surprise and concern when I saw that this contract indicates that the lease is 48 months, not 24, and there was nothing noting the promise of the register. I contacted LFG who informed me that the contract is indeed for a term of 48 months.
I immediately began calling the customer service number listed in the paperwork. I made four calls and was put on hold four different times for a period of 8 to 10 minutes per call, and each time I was told that someone would call me back shortly. I did not hear from anyone. In addition, each person told me that they would send an email to a customer service specialist asking that I be contacted immediately concerning this matter, but with each successive call, I was told that there is no record of my previous call.
I have had to cancel my bank accounts (but not until after they took out over $200 and tried to take out another $200 within a very short period of time), and have spent countless hours and dollars trying to get this mess straightened out. Stay away from these people. They have absolutely no ethics and will lie, forge documents, and mislead you at every turn.
I am not the first to submit this complaint against this company, and all the complaint seems to carry the same story. This is how Payment Systems corp work, they send these sells representatives that probably only works with the company for about a month, and let go. They will go into a business, and will use every trick they know and learned from the company. They will compare the rates of your current credit card processing company with their rates. They'll tell you they will save you money, 1% on all credit card, no fees on debit period with absolute confidence. Then they will say "the company charges $99 for leasing the credit card terminal to cover the low rate that they're offering." When I got the statement, the 1% on all credit card does not exist, for debit cards, they charge lots of other fees. I knew that this was a ripoff, and I am fighting this. Good thing is I didn't cancel my old merchant service, so I have a second option.
When I called their customer service, all they do is slam the contract down my throat, saying "you signed the contract." They don't want to do anything but to piss their customer off. I am still dealing with a handful of people within their company to resolve this, but I am looking to put together a class action lawsuit to fight this injustice. How can a American company behave this way? Payment systems corp will tell you : "most American companies operate this way." As long as more people stand up to this company, they will have to stop preying on innocent business owner that's trying to make a living.

I am writing to explain what happened to a merchant of mine in Michigan. He processed around 60-70k a month, and our company had him priced at interchange plus 10 basis points with a .05 cent swipe fee and his effective rate (overall cost) of 1.6-1.7% every month. When I received the cancellation letter from the merchant, I immediately knew he didnt change to save a few dollars, so I called to find out why he would of switched.
He said he had a "Sofia" from "Payment Systems Corp" came in to one of my merchants businesses and told him he would be saving around 200$-300$ a month by processing with them at her rate of 1% on all credit cards with 0% on debit cards plus 99$ per month for a lease that was month to month (turns out it is non cancel-able) for a terminal that cost a few hundred dollars. Now the merchant is paying a much higher rate of interchange plus 100 basis points vs interchange plus 10 basis points where we had him priced at first.
This is clear fraud that can be proven and I will go to whatever lengths to make sure we put a stop to this. I work hard to save business owners money and lower there cost, and when I find out a crook is on the street ripping them off blindly, I have to do something.
This is financial Fraud and there are literally 1000's of complaints online on PAYMENT SYSTEMS CORP, all claiming the same exact thing FRAUD. I dont know how they can go around breaking the law without people trying to get justice. I'm helping the merchant fight this case and filing a small claims suite against the sales rep \and her manager. When I called Sofia, she did not answer, and when I called Micheal Ponzi he answered and told me she doesn't really work for the company anymore and to call corporate, they have a special department that deals with all the Fraud and legal problems. The way Micheal made it sound, was like this is nothing new to him and jump in line of other people that got screwed.
File your case with the FTC, Attorney Generals Office, BBB(even though thats a waste of time) and a small claims suite against the agent. Thats one way to see there face again and get back what is owed to you.
