On December 2, 2013, I (under my business name, P & K Investments, LLC) purchased a house from Roy Washburn located at 317 E. Steffens, Ennis, Montana, for the sum of $100.00 with the intention of moving it to 220 E. Hugel, Ennis, Montana. On January 8, 2014, I (under P & K investments, LLC) entered into a joint venture agreement with Troy Bentson of the Bawk Fund, LLC On January 9, 2014, we (P & K Investments and Bawk Fund) purchased a parcel of land located at 220 E. Hugel, Ennis, Montana. On January 14th, 2014, Troy Bentson, Jay Oddy (our realtor on this project) and I had lunch at the Bozeman Applebee’s with Clayton Spurlock (Dan’s father and business partner), Dan Spurlock, and Erik Spurlock (Dan’s son). All three of them stated they would be performing the rehabilitation work on the 317 E. Steffens house once it was moved to E. Hugel. We were advised by the Spurlocks that Clayton was he owner of the company, All Fases of Construction, and Dan was a member, and Dan would be spearheading the project. At that time, Troy Bentson, (Bawk Fund) issued a check for the amount of $21,500.00 to Dan Spurlock to commence the rehab/construction project on the Ennis House. On January 15th, 2014, Clayton deposited our check ($21,500.00) into his bank account at Flint Creek Valley Bank located in Philipsburg, Montana. On January 17th, 2014, Clayton withdrew $2000.00 to give down payment to his bank (Flint Creek Valley Bank) for an excavator (Hitachi model 62). On January 18th, 2014, Troy Bentson and I (under P & K Investments, LLC) entered into a revised contract with All Fases of Construction to have the house located at 317 E. Steffens rehabbed by All Fases of Construction once it was moved to E. Hugel. On January 21st, 2014, Clayton issued a Flint Creek Valley Bank check to Jay Schultz (sp?) for the amount of $1050.00 to move the aforementioned excavator from Kalispell to Ennis, Montana. On February 1st, 2014, Clayton issued a Flint Creek Valley Bank check to Elmo Coblentz for the amount of $300.00 to purchase a generator that was never used at the Ennis project. On February 4th, 2014, there was a remaining balance of $1095.60 in the All Fases of Construction bank account from the initial check issued by the Bawk Fund that was never given to Dan for the Ennis house. On February 5th, 2014, Clayton issued himself a Flint Creek Valley Bank check to himself for the amount of $4000.00 to pay for a previous debt owed to him by Dan Spurlock. On February 18th, 2014, Troy Bentson (Bawk Fund) issued a second check to Dan Spurlock (All Fases of Construction) for the amount of $19,460.24. Clayton drove to Ennis and procured the check. In turn, Clayton issued Dan a check for the amount of $14,900.00 to be used for the Ennis house. Also, Clayton gave Dan the signed title to his 1999 Ford F150 XLT half-ton pickup truck and advised Dan that Dan had just purchased the truck for $3560.00 (although Dan did not want the truck). Clayton advised Dan that he took another $1000.00 for the excavator move and $650.00 to purchase a new tailgate for another one of Clayton’s trucks. This leaves a total of $4560.00 from the second check that did not go to the Ennis project. On March 25th, 2014, Troy Bentson (Bawk Fund) issued a third check to Dan Spurlock (All Fases of Construction) for the amount of $12,710.26. Dan gave the check to Clayton, who, in turn, gave Dan $11,700.00 for the Ennis house. This leaves $1010.26 unaccounted for in regards to the Ennis project. On April 23rd, 2014, we (P & K Investments and Bawk Fund) issued two checks for a total amount of $11,787.50 to Dan Spurlock (All Fases of Construction). According to Dan, he gave the checks to Clayton. Out of that total amount, Dan received $11,250.00 for the Ennis project. This leaves $537.50 not used for the Ennis house, and unaccounted for. The bottom line is we entered into a contractual agreement to have our house rehab for a total of $72,500. The final amount has cost us over $100,000. During the end of the rehab, Daniel Spurlock was constantly getting intoxicated and violent, although he is on felony probation for domestic abuse and is not allowed to consume alcohol. We had to remove Dan from the project and get another rehabber to finish it. Clayton Spurlock removed money from the project several times for things that were not even related to the project. Dan's son quit working on the project and left approximately 2 months into it. Currently, charges have been filed in Granite County (Philipsburg, Montana) by us against Clayton Spurlock for felony theft. I would strongly suggest you stay away from these stooges and hire professional contractors with a track record.
