In August 2010, I submitted application for Federal Disability benefits, with Office of Personnel Management (OPM). In Nov. 2010 called to check status. I was advised by an OPM employee that I was not qualified to apply for disability benefits; because I was no longer employed with the government. She instructed me to fax/fedex her a signed statement changing my application to regular retirement. My application wasn't until April 2011, at that time retirement benefits were denied. A Request for Reconsideration was submitted in May 2011 and was held in abeyance until Feb. 2014. In March 2014 my retirement benefits were againdenied. April 2014 filed an appeal with Merit Systems Protection Board (MSPB) , San Francisco. A telephonic hearing was conducted Jun 18, 2014; I became the appellant. and witness. This was due to the refusal/failure of OPM's Legal Officer, Lesley Gordon to participate. The Admin. Judge, Grace B. Carter was totally biased towards the agency throughout the proceedings, and the OPM rep.didn't appear tou take the proceedings seriously. There was no discovery, and the agency was very. uncooperative. The stated in her decision that OPM provided inaccurate/incomplete information relating to my years federal service. The judge used the inaccurate/incomplete information to rule in favor of OPM. Judge in my appeal didn't proceed in accordance with MSPB rules contained on their website.
