This morning before 7:00 am, I received a phone call from an agent that represented NCS looking for someone that I hadn't had any association with in 14 years. The caller wanted me to contact the person and let them know they were going to send over a process server by the end of the day if they didn't hear from them.
Let it be known that collection agencies are doing more deceptive ways of collecting previous bills. While many of them believe that they can collect a debt from some silly debt portfolio that they purchase, the truth of the matter is, that the have no written contract to collect the debt.
With recent revisions to the Sarbanes Oxley Act and article 404, many collection agencies will have trouble getthing the required documentation because publicly traded companies aren't willing to or can't surrender the paperwork in accordance to the paperwork and electronic information policies that they have to adhere to. If the contract ends up in the wrong hands, the corporation that you signed the contract with could be held liable as well that can indlude fines and damages for any harrassment or fraudulent behavior that the collection agency did by representing the corporation.
The best thing to tell a collection agent, is to send you a contract of the debt. If they can't provide one, you have no obligation to pay them and they legally can't collect on a debt until they get it. In some cases, if you gave someone the money over the phone doesn't guarantee that the debt is paid anyways. Many collection agencies are boileroom operations that misrepresent the company they are working for as well as the person that they are collecting from.
Hopefully the FTC and consumer organizations can get rid of this dirty money laundering business once and for all.
