I am a property manager for an Inn located in Manteca, CA. On Feb.23,2015, I had room #13 vacated. Officer Montoya was dispatched to oversee confrontation with the guest and he made log of what happened. I have Officer Montoya's card with that Log information on it. He gave orders that the guest remove all persons and belongings by 6PM. He also confirmed with the guest that they understood what that meant.
After 9PM- OFFICER ANDERSON was dispatched to see a trespasser removed from the premises outside room #19. Security was on site when he arrived, but he did not exit his vehicle. He made Security stand in the middle of the road and told Security "I don't think you know what trespassing is" then drove away with a broken headlight. (The law simply put- Trespassing: person(s) on property when NOT authorized/ without permission)
Guest in neighboring room complained about a party happening in room#13 (which should have been vacated by 6PM as Officer Montoya instructed). When I arrived to the room with Security, there was loud music and peering inside through the wide open door, we saw children and 6-8 adults in the room. The adults were all smoking meth and passing it around. One of the people saw us and closed the door. I immediately called dispatch to send police. I asked that they remove the drug activity and trespassers off the premises. Dispatch tells me "We will send an officer." before hanging up.
I watched a white car pull up and take the children away then 3 adults walked away from the premises. Right after, dispatch called back asking for the address. She sent police to another motel. (she had neglected to ask me for the address prior because of another motel "popular for riff-raff")
When Police arrived they came in 3 cruisers. 1 Officer Anderson, 2nd which I believe I heard Officer Anderson refer to as his Sargent, and the 3rd Officer stood by his vehicle the entire time watching everything.
Officer Anderson was confronted by Security on the matter of trespassing before going to the room. The officer put his flashlight in Security's eyes, raised his voice, and said "this is a different call" (before angrily ranting about the trespasser he refused to remove and was still around the corner trespassing). I told him to please remove the persons and drug activity from the premises. He said "I'm not allowed to just walk in peoples houses." And I immediately informed him- "It's not their house. This is an established business- Inn. Under Civil Code 1940, they have NO rights. You are a Police Officer. And I say you CAN go in there". Officer Anderson said "No, that's not how it works." (Further neglecting the Civil Code 1940 that states Transient Tenants DO NOT have rights)
When Officer Anderson went to room#13, he knocked and said "Police" to the person that peeked in the window. He had to ask 2 times to open the door. He asked 3 times to turn down the volume. Smoke was still visible in the room, but OFFICER ANDERSON did NOT check I.D's, did NOT search anyone for drugs, and did NOT site or remove the trespassers/ drug users. He had the prior guest stand outside to speak with us. When Officer Anderson spoke with ME, he would shine his flashlight in my eyes and not once the person in question. He said to keep the music down and that was all.
When Officer Anderson was about to leave, I told Officer Anderson his headlight was out. He walked over and smacked his light a couple times (which obviously doesn't replace the broken bulb). He joked "now they're going to write me a ticket". I almost expected them to do so, considering I had a fix-it ticketover a license plate cover that I took out in under 2 minutes. But of course, expectations with the police were already deminished. I didn't want the officer's to leave without prosecuting those in violation. But they did. All 3 officer's felt it was perfectly fine to neglect the law.
Officer Anderson KNOWS there are orders for persons and belongings to be removed by 6PM that Officer Montoya also logged. OFFICER ANDERSON neglected to follow through with orders given by Manteca Police already, he undermined any rules our Inn enforces, and he disobeys the LAW itself about Trespassing. He doesn't conduct searches to provide evidence of criminal activity. Not to mention, the disrepect he shows for property management while showing compassion for criminals.
I'd like to see him OUT of duty immediately and indefinitely. (I don't even care about paid leave, because I'm already paying taxes for him to not serve while IN duty). Who knows how much he has gotten away with during his term so far. I wonder how many other businesses are fed up with his disrespect and LACK of actions.
