Lisa Chilton owns unit 11 at 5400 Newcastle Ave, Encino California 91316. LBPM is the property management company hired by HOA to manage the building. On January 26, 2015 unit 11 was covered in raw sewage caused by the common use pipes backing up. The raw sewage leaked from unit 11 to the laundry room directly below unit 11. LBPM send someone into unit 11 to assess the problem. LBPM knowing the unit is vacant and having the phone number and email address for Lisa Chilton on file shut the door, never cleaned the damage and NEVER CONTACTED Lisa Chilton. LBPM choose to allow raw sewage lay all over my unit leaving a potential hazard to all the residents in the building. The raw sewage remained all over my unit until I returned back to Los Angeles on Feb 1, 2015 and noticed the damage. February 2, 2015, I cleaned up the damage with the help of a few plumbers. The wood floors warped because the raw sewage remained on the floors for a week. The floors would not of warped had Lisa Chilton been notified immediately and been able to send a crew to fix the damage. Lisa Chilton went to the LBPM office on February 11, 2015 to speak to Nick Hoffman since all calls to him from Lisa Chilton from February 1 to February 11, 2015 went unanswered. Nick Hoffman is the property manager and was aware of the damage to Unit 11. Nick Hoffman was only able to scream and blow off Lisa Chilton so she spoke to supervisor, Janice Eisenberg.

On February 13, 2015, Janice Eisenberg contacted Lisa Chilton to inform her that a claim was filed and the unit would be fixed. February 14, 2015, Raul Garcia from LPBM was hired to rent Unit 11. February 28, 2015, Raul went to unit 11 and noticed that the bathroom linoleum and wood flooring was removed from unit 11 and a heater and fans were left running in the unit. Raul contacted Lisa Chilton who was unaware of any work being done to unit. One of the workers called Lisa Chilton to inform her that LBPM had sent the company to unit 11. LBPM allowed this company to illegally gain entrance into unit 11 and rip out the linoleum and wood flooring. This is WITHOUT the permission of Owner Lisa Chilton and WITHOUT even informing Lisa Chilton of their action. LBPM would not return calls so Lisa Chilton could find out what is going on. Lisa Chilton filed an insurance claim with the HOA insurance.

Farmers insurance came to access the damage to unit on March 5, 2015 and issued a check on March 9, 2015. Insurance awarded damages to unit 11 in the amount of $2612.47 and $2521.53 for the laundry room for repairs. The insurance policy has a $5000.00 deductible so LBPM received a check for only 134.00. LBPM is now informing me that there is no money to repair my unit because of the high deductible so Lisa Chilton will have to get estimates and the HOA will have to vote to see if they will pay for damages to unit 11. In summary, the damage to unit 11 is caused by common use pipes. HOA is responsible for the cost of repairs. The floors to unit 11 would not of warped had Nick Hoffman of LBPM contacted Lisa Chilton or sent a company to clean up the damage knowing that raw material is hazardous to all the tenants in the building. Instead, he was grossly negligent in shutting the door to unit 11 and pretending that there was no problem. LBPM illegally gained entrance into unit 11, and hired a company tear up all the flooring in unit 11 WITHOUT the owner’s consent or knowledge. Insurance paid 2612.47 for repairs to unit 11 but LBPM will not repair damages because of the high deductible. If you are going to go into someone’s home without permission and rip up the flooring then you need to put the unit back together.
