I met with Eric Anthony Lanigan to obtain assistant on the foreclosure for my house, in good faith I trusted he will be doing all the necessary step to help me with my case especially after giving him $2000 down to begin working on my case, But all I got in return was just an emergency chapter 7 which I could done it myself. Do not trust them to work on your foreclosure case, he has no knowledge whatsoever how to fight your case in court and now he passing the cases to a non lawyer who can't do much in your defence.
He was never available when I called or have the curtesy to return any of my phone calls or emails.
I hired eric lanigan in june 2014 to collect on a debt in a case in which the court had already granted me a judgment against the debtor. Eric lanigan offered to take the case on 25% contingency with a $1500 initial charge and i was to be responsible for "out of pocket expenses...From the recovery" "if there Was) a recovery."
From the beginning i started having problems communicating with eric lanigan. He blamed it on a holiday or that he had "pre-existing cases" he also needed to work on As if i thought mine was his only case). He acted as if he was scolding a child instead of communicating with a client for whom he was providing a service, and for which he was paid a retainer. Needless to say, had he done the job he was hired to do, he would have been paid a lot of money for doing little work.
A deposition of one of the defendants was scheduled for september 2014. I showed up for the deposition and was told it had been cancelled. Four months later January 2015) the deposition of the same defendant was held. I was not notified of the rescheduled deposition despite notifying eric lanigan and his assistant that i wanted to be present at all depositions or hearings involving my case.
Despite the agreement that i would be responsible for expenses if and when a recovery was obtained, i was sent statements to pay for costs involved in the deposition that i was not even allowed to be present for.
After this i was unable to get a hold of eric lanigan by phone or e-mail. It became very difficult to even get his assistant. At one point, having already left messages that went unanswered, i advised the receptionist that i would hold on the phone until eric lanigan's assistant got off the other "call."
Instead of keeping me on hold the receptionist transferred the call to eric lanigan who literally yelled at me on the phone for "calling Him) in the middle of the afternoon..." he further stated that he was "in the middle of a deposition..." when i told him i had not asked for him, but for his assistant, he calmed down and told me he would call me after the deposition was over. He never called, i tried multiple times more to contact him via phone and e-mails without success.
I finally had no choice but to find a new attorney, pay a new retainer and start all over. Eric lanigan did not want to work on the case. He was just hoping for a quick settlement, make some money quickly and move on to the next case.
Beware: if you do not get a response from an attorney with whom you have a representation agreement, file a complaint with the court prior to getting a new attorney. Basically, by getting a new attorney first he was released from responsibility under the agreement. If they want out of the case for any reason, forcing you to get another attorney is their way out without repercussions.
For the grand finally, i received a "motion to withdraw as counsel of record for plaintiff and notice of hearing" from eric lanigan for a hearing in may 2015. Needless to say, he did not show and i was there trying to tell the judge why i was there only to have her state that my only choice now was to file a complaint against eric lanigan with the bar association.
