This scam is almost verbatim a replica of another reported scam on Cordell & Associates operating from the same address. For all I know, these are the same people. The FL Bar confirms that they've never heard of them. They are not on LinkedIn, and I suspect that these are not their real names.
On July 22, 2014, I received a call from Gordon Downey, a supposed Attorney with Kirkland & Associates out of Florida. He claims his firm is representing investors who lost money on an investment and that they were able to recover 11.2 million dollars in the out-of-court settlement as a result of a Class Action Lawsuit. This is enough money to pay back investors 70% of their money, but that the firm would be keeping 20% of that as their retainer, so I would end up with 50% of my initial investment.
Mr. Mills further stated that the "mandate" ends in August (meaning other law firms would then be able to file lawsuits against this failed company); so he was going to e-mail me all the information and forms I would have to read and sign, and he also stated I would have to sign a Release BEFORE my money would be distributed to me. He also stated I would have to send approximately $4200. of the 20 percent retainer to his firm UPFRONT and that I could mail the payment along with the signed documents. I have the documents that they wanted me to sign. I told Mr. Downey that I would arrange a conference call with my attorney to confirm, but that hasn't happened. This guy is very smooth & polite.
Warning bells were going off the entire time we had this conversation, as I'd lost my investment over 7 years ago, and not once did I ever receive anything in the mail regarding a Class Action Lawsuit against the failed company. Then, out of the blue, I get this phone call and he knew my name, how much I had invested, etc. I have spoken to him several times, but I have not been able to confirm anything that he claims to represent.
Step 1: Establish a website in Canada and operate out of Canada.
Step 2: Establish a virtual office in the U.S. to give the company legitimacy.
Step 3: Find out information about people who were defrauded and contact them.
Step 4: Persuade the defrauded victim to retain the services of the fraudulent law firm.
Step 5: Persuade the defrauded victim to sign documents and send a payment to retain services.
Step 6: Payment is received at the virtual office mail service.
Step 7: The fraudulent law firm establishes a time to shut down the operation as soon as it collects enough money from the victims. By the time the authorities are on to the operation it is too late.
I hope that I saved someone from these nefarious individuals
