When I originally viewed the rear apartment September 3rd, the front appeared neat, clean, no weird characters, and I liked the place. A skinny tall black guy, who I believe was her son, told me four (4) people were working on the place and it would be finish by that Friday, September 5th. Being in construction, when we signed the lease I agreed to wait until September 12th, the following Friday. Kerlyn assured me that was plenty of time.
On the 10th, in front of the main house was the same tall dirty raggedly young man, a dirty stocky guy, looking anger at me, and a straggly dirty hair filthy smelly white female. When I went to the rear there was only one guy working. When I asked if I could get the keys he told me no because he leaves his tool there overnight so only he had the keys. As I looked around there was no refrigerator or stove, one window was missing burglar bars, all window tiles need replacing, the bathtub was rusty and there were no screens to the windows. When I asked him what he was going to do about the tub he told me he didn’t know what she was planning to do.
Leaving, I was worried that I was making a mistake but I felt I was bound to a contract and I was looking forward to seeing what it would look like finished and the things could do with it.
On the 12th when I got there with my property the same skinny guy told me that the place wouldn’t be ready until the next day Saturday the 13th; because, the repair person just pulled the tub out busting a pipe and was gone to get the supplies to make the necessary repairs and install the tub. Once again knowing construction, this was totally unacceptable. During my conversation with Kerlyn I was very upset and she tried to assure that the place would be ready by the next day. I told her it would take about another 3 to 5 days for one person to repair a busted pipe line, install a tub, replace screen, replace window tiles, and who knows what else.
I simply told her I just wanted my money back. She told me that was not the way it worked because she had turned down potential rentals and we signed a contract. When I explain to her that she has broken the contract, I have not taken control of the premise, and if I didn’t get my money I would take her to court. She said I don’t think I want you as a tenant. You are not the right person for this place. You will get your money but on my terms when I rent the place that the money I had given her used it to renovate the apartment I was moving into. When I asked her what she would have done if she hadn’t gotten the money from me she just simply said was, “Well that’s business. You signed the contract.”
When I asked her what was I suppose to do for the night. She asked me, “You have no place to stay tonight.” I told her no. She told me the least she could do is put me up in a motel for the night and she would call me with the information and the place would be ready the next day. I sat in front of north side metro rail station for over 2 hour with my luggage and when I called her she wouldn’t answer the phone or text, I rented me a motel room. The last conversation I had with Kerlyn she called me Saturday, September 13th, 2014 for me to come pick up $700. Considering what I observed on the 10th, no way I was ever going back over there to end up missing in action, was my fear. I told her to mail it to my post office box and she said she would. Wednesday, the 16th, there was no mail from her. She wouldn’t answer the phone but did reply in a text, “That’s exactly why I wanted to give it to you in person instead of mailing it.” I told her maybe it would be there the next day Thursday. I waited to go to my box that Friday the 18th receiving no mail and my calls and text to her was unanswered.
Tuesday, October 7th, I called FPL about a notice they sent me and learned that both the main house and the rear apartment has lights meaning she rented the place but still made no attempt to give me my money back. When I contact FPL light September 8th for startup services I was told there hadn’t been any power in the main house for quite some time.
