Relied on the seller's high quality description on ebay of a deep well submersible pump and purchased it on Dec 15, 2013. I tried contacting the seller about the pump before installation. The seller never answered. I unpackaged the pump and started work on installing it in March 2014. Finished the installation; the pump would not run. It needed to be restarted after a short cycle. I contacted the seller on March 4 & 6, 2014, to get technical data to determine why the pump would not run and finally information on where to return the pump for warranty service. The seller ignored my requests and never answered any of my emails, even though sent thru the ebay system. On the littlewallabies web site where this pump was advertised he states “ALL EMAILS ANSWERED IN 48 HOURS”.
March 18, I was able to make contact by using a similar ad and asked “Hi, how do I contact seller to exercise Warranty Service”. They answered: contact 626-810-6662. March 19, 2014. .I made contact and spoke with Kelvin Chao, after explaining the pump would not run he abruptly said, “Send it back”. I asked him don’t you need to send me some kind of authorization? He said, “No just send it back”. I then asked for a specific address.
The pump was sent back on March 28, 2014, they received it on April 3, 2014. In spite of my numerous attempts to contact the seller to determine the status of my pump they have never responded. Currently they have both the pump and my money! (Something that would not happen in Judge Judy’s world).
Ebay and PayPal tell me I exceeded their time limit for making claims and they will not intervene. My professional well man states it is impossible to MFG a high quality stainless steel 2 HP pump anywhere and sell it for $300 including the shipping,. His theory: the seller knew he was selling defective pumps. My electrician states the wiring to the pump was properly installed. I can provide time line with emails, affidavits and receipts.
My claim is based on the seller’s poor business conduct and representations he did not honor. I submit a claim for recovery of the cost of the pump, $300.00, shipping materials and postage $104.00, for a total of $404.00.
