Luz Gongora was an employee of HT Hackney in Lenoir City Tn. she suffered a ruptured colon (not on the job) on 6/23/12 and was hospitalized for almost 2 months over the following 6 mo. during that time i (Roy Cook, her husband) kept HT Hackney informed at to her progress which was complicated by her dialysis. there were other complications so she didn't have her colon reattached til mid-November. at that time the doctor was going to release her on 12/19/2012 to go back to work. we assumed everything would be fine til we recieved an email from Dewan Lamb (aka the lying b*tch).
she asked for a meeting with Luz and i suspected something was fishy because she said Luz had to come back to work with a medical release by 12/9 or she would have to be terminated. we met with the lying bitch on 12/6 and explained that we could get a letter from the doctor stating she would be released on 12/19 which was just 2 weeks away. Mike Moore (the forman) was there too and acted like a freakin tool and didn't say much. they did say she should reapply in late feb. 2013 as that is when they usually start hiring people again. needless to say, Luz has reapplied and there are no opening according to the lying b*tch.
i suspected and still do that the reason for the rush in dec. was that they had discovered that Luz was a kidney patient and didn't want her on the medical benefits due to the costs. they of course deny this but it had already been over 5 months. what difference would another 2 weeks make? they terminated her even though we offered to go to the doctor and get a letter saying she could go back to work on 12/19. the lying b*tch said not to bother as it wouldn't make any difference.
skip forward to 12/19 Luz calls them and asks for a ""notice of separation"" so she could file her unemployent claim. she couldn't file til she was medically released and the Dewan Lamb knew this. she told Dewan Lamb (the lying b*tch) that she had been medically released and the unemployment office would need that to process her unemployment claim. the lying b*tch said she would fax that to Luz when she paid for the other 2 weeks of medical benefits that i hadn't paid for yet. and you better sit down for this.....it was less than 200.00. how very christian of the lying b*tch. knowing Luz had been w/o income for 6 months she wants that 200.00 now even though i told her we would pay it as soon as we could which would probably be in feb. anyway Luz filed the claim for unemployment benefits as the unemployment office told her they could get the separation notice.
skip forward to feb. 2013. luz had been collecting for about 4 weeks and the lying b*tch files a protest with dept of labor contesting luz's benefits and says she was never supplied with a medical clearance and Luz never called to say she was available for work. the hearing was held the first week of March and they found in favor of HT Hackney and the lying b*tch. we contest the appeal and lose because we have no ""written proof"" that Luz did let them know she was available for work.
this was last week and i had contacted Mike Morton (chief financial officer) and when he got notice Luz had lost her appeal he called Nicole Davis at the unemployment office and told her a ""mistake"" had been made and they never should have contested her claim. of course he only did this after i threatened him with legal action as i had ordered a transcript of the hearing and caught the lying bitch in about a dozen lies. seems lying under oath is a felony too so we will see where that goes. unfortunatly this won't expedite the appeal of the appeal. yeah.... the CFO calls and says ""ooops; we made a mistake"" and it does nothing.
Mike Morton said last week he will get us a letter saying Luz did make herself available for work on 12/19 and now 4 days later we can't get him on the phone. seems he's had a change of heart. he thinks if we file an another appeal HT Hackney can just ignore it and we wil win and the world can go on. that is not the case. we have spoke to the unemployment office and they won't even notify them of another appeal. and i finally got a copy of the letter and it doesn't say the most important phrase ""LUZ MADE HERSELF AVAILABLE FOR WORK ON 12/19. seems if he speaks the truth it could get him in trouble i guess.
everyone's solution now is to just have luz ""reopen""her claim. yeah and she can start to collect by the 1st week of May AFTER the 2k she's recieved is paid back. they make her pay it back by not paying her for the weeks since the appeal was lost in March. so she ends up losing 2k thanx to the lying b*tch at HT Hackney who commited perjury (a class d felony).
and just now gerald jabaley (their attorney) just called me and asked me for my home address. wow now they've got a hired gun. good for them. i hear he bills them at 400/hour and i kept him on the phone for 30 min. wonder if he'll bill them for the whole hour.
