I have hired HomeGuard Inspections for a few years to preform inspections for clients who were buying homes. Generally they were go to use until the last time I used them. My client asked me to recommend an inspector of which I told him about HomeGuard whom he asked me to call them and schedule for the service and I did so.
I told HomeGuard that I wanted to help my client out that if he could not pay for the service I would. HomeGuard preformed the service and my client told me not to pay for the bill that he would take care of it. I informed HomeGuard and they miss billed me for the inspection. I called HomeGuard and told them to get the buyer and he would take care of it.
In an email dated April 21, 2014 told HomeGuard that I tried to pay for the invoice via paypal but it had the wrong email address. Later that day HomeGuard responded back to me and here is the exact text that HomeGuard “Brad” sent to me: Hi Jeff,
Thanks for your gesture.
Would you consider having the invoice paid at closing -send a check via the title company at settlement.
If the deal doesn't close, then I'll write it off.
Either way, I don't expect you to pay.
Let me know your thoughts.
Brad
As you can see Brad thanks me for me gesture, is willing to wait till the close to get paid and acknowledges that the payment of bill is not my responsibility.
My client called HomeGuard and told him that he would pay the bill and not to bug me about anymore. My client asked how to make payment to HomeGuard and was willing to pay, but they were not willing to take payment. This occurred on four different occasions.
Several months after closing HomeGuard contacted me in an inquiring matter for and update on my clients transaction. I told Brad that we had closed and he at that point asked for payment.
Brad told me that I was responsible to him for payment of which I have no legal responsibility to do so. Brad sent me an invoice for the fees and I told him that my client had try to pay him but he refused.
After this phone call I followed up with my client as to the status of payment to HomeGuard and my client once again said that Brad would not take payment.
My client told me that Brad made “client feel very uncomfortable and made treats to him and became vocally abusive”. Brad made an assumption that he could get paid on the closing HUD documents for my client, which is not possible and I told him that. My client was refused payment several times and Brad became very unprofessional in his conversations to my client.
Brad then later threatened me and my broker to file a complaint for non-payment. To avoid and issue my Broker paid him on 9/4/14.
Brad posted on ripoffreports.com about this issue and lied as to all the real facts about what happened. I contacted Brad to remove the slanderous statements which are not true. And he denied the that he did, yet his address and statement are only prevue to me, my client and broker, so who else would have done it. During the conversation was rude and hung up on me. I tried to call him right back and he did not answer. I left him a message to address his false statements and that was a week ago of which he still hasn't.
The disturbing fact is that Brad is willing to harm another person's business and not think anything of it especially with the whole issue was a COMPLETE LIE!
