Getting interested in the used 2006 Ford Fusion 4 Door Sedan 4 Cylinder, I inquired the owner of the used car dealership, Mr. Harbans Bharaj into its conditions and price. The first contract I signed was conditioned on certain financing. Deposit for the car and manufacturer’s warranty were left under the circumstances. Friday, December 20, 2013, after days without entering into the retail installment sales contract (due to the financing discrepancy), and countless excuses about the delay, I insist my deposit be refunded to me if the deal is not finalized. Friday, December 20, 2013 while entry in Hilltop Service Center the owner, Mr. Harbans Bharaj “ I got you what you wanted.” Using (Five-Finger Close), sign here, sign here, sign here …without giving me time to read or see what I were signing. Signing I found the retail installment sales contracts backdated. The monthly payment rates did not reflect the negotiated financing terms. When hesitating to sign.
The owner, Mr. Harbans Bharaj would point to the documents in a demanding position repeatedly. “ call law enforcement.” I fell for the pressure and signed. The seller, Mr.Harbans Bharaj engaged in a pattern of fraudulent, deceptive and illegal business practices in the sale and financing of the subject vehicle. The date of Friday, December 20, 2013 the owner, Mr. Harbans Bharaj, the seller falsified his identity to Bordentown police department. Manager, Mr. Emilio Grace were not present when or after the incident took place. The illegal practices left me with ruined credit reports. The deceptive conduct led me to sign contracts which did not reflect the negotiated sale terms, frequently including add-ons, GAP Insurance and a manufacturer’s warranty. Some of these transactions led to the repossession and ruined credit, as I found myself owing more than I ever would have knowingly agreed to pay. Tuesday, December 24, 2013 in possession of the 2006 Ford Fusion I brought into DAI Auto Repair mechanic. Subsequently, I discovered that the 2006 Ford Fusion had pre-existing conditions that required extensive repairs, Front brake, Rotor, Replace water pump, Drive belt, Anti-freeze and Missing Parts. As such, the value of the vehicle was greatly lower than what I had paid for it. The owner of Hilltop Service Center, Mr. Harbans Bharaj, the seller had failed to disclose this material information to me at the time of purchase. And have failed to honor the promised warranty protection.
As I itemize documents it identifies the manager, Mr. Emilio Grace, the seller, when in fact he is not. It is evidence that the owner, of Hilltop Service Center, Mr. Harbans Bharaj intent to deceive and defraud me as he finds it necessary to conduct his business. I had attempted to reach an agreement with the dealership and finance companyprior to the complaint, but was treated with disrespect and refused a remedy. I wish to get out the obligation of the retail installment contracts. Awarded punitive damages, actual damages, and proximate damages. And the removalof any negative reporting on my credit reports to Experian, TransUnion, and Equifax associated with Credit Acceptance Corp.
