On sunday, april 26, 2015 at 5:30 p.M. My daughter, her fiancée and myself arrived at hb towing to recover her vehicle a 2012 honda civic of which i purchased in cash for her graduation in 2012. The vehicle was towed from montego falls apartment complex 9950 bruceville road, elk grove, ca 95757 via paladin security, which is outside of the 10-mile zone that tow truck companies are to operate within.
At approximately 4:00 p.M. My daughter came to my house to get me because i was the registered owner of the vehicle and the towing company stated that the registered owner must be present in order to pick up the vehicle. When we got to hb towing we were met by a male named brandon, he asked for the driver’s license of the registered owner and the car keys. Due to the dramatization of all that happened my daughter inadvertently forgot the car keys to the vehicle. While my daughter and her fiancée were outside in the car looking for the car keys for the car i approached the window where “brandon” was and said to him “i am sick since you have seen my id can they just come back and get the car without me because i was having a sinus attack and my allergies were flared up”. Brandon began to get irate, nasty and flat out rude with me. He said, “nope i’m leaving i have something else to do” and you will just have to come back tomorrow. I asked him nicely not to get snazzy with me and an argument between he and i ensued. He then threw my driver’s license at me while i was still present in front of the bulletproof glass via a small slit. It was then that i became irate and used profanity because i was being totally disrespected, abused and disregarded in a place of business as a consumer.
After the heating argument i walked outside and tried to call the phone number on the window, which then rolled over to brandon, and it was then that i told him that i was calling the police on him. I then called the sacramento police department and asked for an officer to come to the scene. At approximately 5:54 p.M. I received a telephone call from a coworker from inside of the towing company and i told him that i was not going to speak to him because the police were pulling up.
I have done some research and it does appear that both hb towing and paladin security are working together to tow vehicles. This is a violation of 22658 of the california vehicle code section E)(1), which states that general authorization Meaning authorizing itself to tow cars) cannot be given to a tow company. A member of the hoa or private property owner must give authorization As stated in L)(1)A) of the same vehicle code) to tow a vehicle. The only exception for this is if you are parked with 15 feet of a fire hydrant At which time a picture must be taken as evidence of such infraction).
It is against the law to not make available someone’s car after towing it. It is illegal to tow a car outside of 10 miles from a private property without prior authorization from jurisdictional police department. I called elk grove police department and they stated to me that “they have no written agreement with hb towing and the average towing fees in the city of elk grove is $170”and hb towing told us verbally at 1:46 p.M. That the fees to pick up my vehicle the same day that they towed it would cost $330 which almost double the fees charged in elk grove where they towed my vehicle from. It is also illegal to charge more then a tow and 24hr stow that will also be against california vehicle code section 22658. In which it states of a owner or legal representative contacts towing company within 24hrs to resolve issue, pays fine, proves they have rights to the property they will only be charged for the tow and at max 24hr stowing. He refused to meet with us at that time and stated that we could make an appointment at 5:30 p.M. To pick up the vehicle.
Those actions above violate assembly bill 2210 Goldberg, chapter 609, statutes of 2006) protects consumers against the worst of illegal towing.
1. Ten-mile limit a tower cannot take your vehicle to a storage lot that is more than ten miles from where it was parked.
2. Clearly posted warning a tower must have written consent from the property owner or his agent, who must have waited one hour before calling for the tow. Also, a sign not less than 17 inches by 22 inches in size should be displayed in plain view at all entrances to the property.
It should prohibit public parking and indicate that vehicles will be removed at the owner’s expense, and post the telephone number of the local traffic law enforcement agency and the name and telephone number of each towing company that is a party to a written general towing authorization agreement with the property owner.
3. Reasonable gate fee the gate fee, or maximum hourly charge for releasing a vehicle after normal business hours, shall be one half the hourly tow rate charged for initially towing the vehicle, or less
4. Penalty for excessive charges a person who charges a vehicle owner a towing service or storage charge at an excessive rate is liable to the vehicle owner for four times the amount charged.
It is well known in the community that john grandchamp's hb towing company behaves and conducts and performs egregious business. That tow company is just another old school shake down. For years now, john grandchamp has been under investigation for countless acts of fraud-state and federal, grand theft, tax evasion and numerous other charges, his clients Mainly apartment complexes that paladin set him up with for the kick backs). It is my hope that the sacramento police department will take a look into this company because they are not honest people at all.
