In Feb of 2014 (Short story was that I lost my job a few years earlier with more than a 20% cut in pay and still hadn’t recovered due to the economy) I had agreed to a contract modification to reduce my interest rate (permanently) with Green Tree. This was after doing the 1 year modifications (that started when I lost my job around 2010) and every time it went back up, I got behind on my payments (still do not make the same salary before my lay-off).
I did all the paperwork and the Green Tree Rep (Rene) said he was able to get me a permanent modification since the yearly mods were not helping and that my primary mortgage company had already agreed to a modification to reduce my interest rates. Green Tree is a second mortgage. The lower rate was offered and recorded (at least that’s what he said) to document our agreement. My March payment reflected the new payment we agreed too and I paid the new rate for over a year (up to June 2015).
Green Tree (Nickey) is now saying that I verbally agreed to a 1 year modification only and that I was notified by mail (not certified and they claim it’s not their policy to send changes certified). Of course this upset me and I asked for the recording to clear up this discrepancy.
Green Tree is ruining my credit and being very abusive and demanding that I adhere to a contract that I did not agree too nor sign. Their claim is that I agreed verbally, but will not provide that recording without a lawyers request for a copy of it. When I asked where to send that request, I was only given a fax number. I even asked “Nickey” to listen to it (she claimed it’s for internal use only) since it would clear up what was offered and agreed too. She said the offer at the time was only “pending” and if it had been approved, I would have gotten paperwork to sign. It did not matter that they did reduce my payment amount (and statements) to match the offer that I agreed to. Her argument was that it was a temp verbal agreement (since I didn’t sign anything for a permanent modification) but that my Verbal agreement was for a 1 year agreement (that I also did not sign).
Now they are saying I’m over $1000 behind and threating to foreclose my home. I will fight this and would invite anyone else who is in the same position to join in to put these people out of business for their tactics and unlawful actions.
I apologize for any rambling but I’m so mad I can’t see straight and my blood pressure is way above normal that I need to go take my medication.

On May 28, mere days after my father died, I recived a call asking if the house was vacant. I said yes and the Green Tree representative asked if I would be making the payment. I had just began opening the estate with my attorney when she threatened me stating that if I did not make the payment, she would change all the locks and the foreclosure process woould begin. Talking to me a ver condescending manner. I told her that I want to work with her and get the house sold to pay off the mortgage. She was more interested in getting me to make a payment I did not have. When I said I couldn't pay the payment, she hung up on me, more than likely to begin foreclosur proceedings. All of this when my father's body is barely cold. Simply astounding. The account number is 683696199. If anyone from Green Tree Serviicing even cares, which I am sure they don't. I heard people laughing in the background. As if my father's death is some sort of joke.
My previous mortgage company sold my loan to Green Tree. I always send an additional principle payment that is received by the mortgage company 5-7 days before my mortgage due date on the 1st. I never had a problem with my previous mortgage company applying my payment properly and upon the date of receipt.
Each month I have to call Green Tree to have my payment applied to principle only, and back-dated. This company refuses to do the right thing. I have been told, "you need to send a request in writing to re-apply the payment, or we will note your account stating that extra payments go to principle only, or we will put in a request to re-apply; this could take up to 10 days."
These folks are knowingly doing this on purpose. They get more interest this way. This is so wrong on many levels.
These people are among the most unprofessional ccmmunicators I have ever encountered in my 81 years of business relationships. They charge $12 to receive your payment. They overrate their Escrow requirement so they have your money (more than required) all year before payment is made. They demean the client at every opportunity. I had an unblemished record with BofA before the account was sold to Green Tree. Since then they have treated me like an absolute dumb, deadbeat. One month I was 8 days late and they indicated they were going after the entire amount of the mortgage or forclose. She then screamed that I was a squatter on their property. They have called me about 6 am on four or five occassions which is against California law. The entireity of my complaint is too long for this comment session, but I will conclude by saying that these people should be put out of business!
On june 2nd 2104 i recieved a harrassing call from greentree asking me when i was going to pay my junes mortgage. I was shocked because i have never been harrassed before the 16th of the month.she told me it was a courtesy call i said call it what you want its still harassment. we are under enough pressure in life we do not need this bulls*** in our lifes they are aweful people to work with. i asked them to sell my mortgage back to boa but dont think that will happen.
Access Recovery(which is Greentree) put a stop payment on check, had Insurance reissue a check, cashed check on 1/29/14, as of yet had not posted $7,921.62 to my account, now has threatened to keep entire check. I had to know someone to get the police report, (without report, Insurance would have not paid) Police did not want to do report because I was told that this was a civil matter not criminal. Was told numerous times by Greentree that I would get sent a refund for difference of check. After check was reissued, payment was never posted, Credit Bureau, is still showing that this debt has not been paid. Greentree advised that check was not recieved, New check number is 780051158, they are lying that this was never recieved, my Insurance adjuster faxed front & back copy of check that Greentree cashed. Please help me with this nightmare.

Greentree stated that they would accept defecicency of $7921.62, Insurance sent my husband & Greentree a check in the amount of $22,832.28. Police did not want to give me a police report because I was told that this was a civil matter, not criminal. my daughter happened to have a customer who is a Judge, this was the only reason I was able to get a police report. Access recovery (which is Greentree) put a stop payment check & had Ins. reissue a new one, check #780051158 which was cashed on 1/29/14, adjuster faxed front & back copy of check, my account was never credited, was promised numerous times, that I would get a check sent for difference, a Mr Stefans in accts receivable was very rude to me & stated that Insurance sent them a check for only $7,921.62 I told him that he was a liar, he threatned to hang up on me, that I was looking for compensation, I paid Insurance premium & police report(without that Ins. would have not paid), till this day they are telling me that I have 10 days to respond, Credit Bureau was never notified that this has been paid. 15 years ago my wife and I borrowed $20,000 from a company called Conseco Finance our payments were $393 per month and as new home owners we were excited to do some repairs with this home improvement loan. To our surprise the loan was sold to Greentreev. We have paid $393 a month for 15 years and still owe the exact same amount that we borrowed 15 years ago. We have actually paid them $72,000 to date when we only borrowed $20,000. We have tried to call them and their representative Adam H basically told us that they were putting a lien on our house and that if we couldn't afford the loan we shouldn't have borrowed the money.
We tried explaining that we were down to one income due to a layoff and that we were calling to find out how we could get some payments deferred. They were so rude my wife had a panic attack and I'm outraged!! when we make our $393 every month only $40 goes towards the principle. We only have 9 years left on our mortgage and this loan will still not be paid off!!! What a ripoff!!! Basically because we are willing to not pay them without refinancing our credit score has gone down tremendously and we are not eligible!!! This is a predatory loan and I beg anyone reading to not do business with them if you are a new homeowner!!!
