Mark diaz of gentec manufacturing tried to rip us off for $2,500. See below, we are currently working with ebay officials to resolve this case. I did some searching and found he has a track record.
After my discussion with the ebay rep on monday, i was instructed to communicate the issue to you and to allow you 2 days for a response. If no response was received then i am to communicate back to ebay to open an investigation into the matter as to whether you used ebay to advertise but then completed the transaction outside of ebay to avoid paying fees. Please respond to this message by 12pm pacific time today or i will be contacting ebay once again. If you will be cancelling the transaction i will be demanding $2,500 compensation to recover costs incurred with respect to my purchase and preparation. Paid via paypal by midnight today may 1, 2015.

When you first called in about the zeiss cmm we explained the machine was on hold and being inspected by another buyer. We also explained the first customer in line put down a refundable deposit and will pay for the machine in full after the inspection if the machine met their satisfaction. We explained we could put you next in line to go see the machine if they decided not to move forward with the purchase. After you went to our ebay store and hit the buy it now button.
Then you called in again demanding we needed to either have you go look at the machine or send you money which was very strange and not common. You threatened us with contacting ebay if we didn’t “compensate you for damages”. I explained to you that if the machine wasn’t on hold and if we didn’t receive funds after the inspection we would be more than happy to have you go see the machine. You kept asking and steering the conversation back towards “compensation” not ever engaging in the machine or its status. I asked you to explain and justify this compensation and your response was you “made a few phone calls”. Even attorneys don’t charge $2,500 or a few phone calls. It is not clear to me what damages or compensation means for a situation like this nor do i agree you have entitlement for such claim.
We advertise on ebay, craigslist, bidspotter, machinetools.com, trade publications, email blast and a few other marketing sources. Ebay is just one of many and we also pay fees when a sales is completed. We counter any and all offers received. We believe ebay does a great job and have no issues with paying their fee’s for a completed transaction. I will be more than happy to show the ebay official the time line of the deposit wire from the other buyer, full payment date received and compare to your buy it now and emails.
The only other dispute we had on ebay was over a machine that ended up in question was tied to the company closing down and we explained to the buyer the machine had liens and it was in his best interest to not move forward while it still has liens. We helped him find the auctioneer and get him information about the auction. We lost the sale and have no affiliation with the auctioneer or the liquidation sale, but we did the right thing and protected the customer which he appreciated. Doing what’s right, fair and ethical is very our standard for all business and culture when helping american manufactures. I will still look for a comparable machine for you and do the right thing, but will not agree to give you free money because you feel entitled for being compensated for few phone calls.
