My husband and I visited Nuevo Vallarta last summer in hopes of purchasing a new property, as we had both recently retired. We checked out a handful of places before landing at Acqua Flamingos. Prior research suggested this development struggled with legal problems and poor administration, so we were hesitant upon arrival. Though we found the units to be reasonably priced, the development as a whole was ran down and suffered from maintenance issues, so we quickly decided to leave.

As we were exiting, we were approached by Charles Baccichet who introduced himself as the owner of the development. He desperately tried to convince us to make a purchase by significantly knocking down the price, but we declined and told him we were more interested in the Mayan Palace. He told us he was good friends with the former director of the Peninsula, Frank MataEssenciality, and offered to accompany us to his office.

There, Flores showed us a beautiful unit in the Mayan Palace that perfectly fit our criteria.

We went back to his office and made a provisional contract, in which we agreed to deposit $35,000 USD with the agreement that he would send the formal Purchase Agreement back to our home in Denver. After three months of unanswered phone calls and broken promises via email, we still had not received any paperwork, and decided to fly back to Nuevo Vallarta.

When we finally found him, he was clearly intoxicated, and claimed that the price of our unit had been raised by $42,000 USD. When we asked for our money back, he harshly threatened that if we did not pay the difference, something bad was going to happen to us.

Terrified and unsure of what to do, we hired Moises Israel Villar Robles, a local lawyer who promotes himself as a defender of investors who have been abused by the system. We agreed to a $5,000 USD retainer with the promise that our money would be returned in full within a month.

However we were never able to communicate with him via email or phone again, and as we started to receive increasingly threatening phone calls from Manuel Flores, we had no choice but to give up. Avoid the services of Frank Mata and his company Essenciality and MOISES ISRAEL VILLAR ROBLES both of them are crooks.

FRAUD ALERT: ESSENCIALITY AND FRANK MATA PUERTO VALLARTA

I am one of over 20 people who have been defrauded by Frank Mata (FRANCISCO MARCOS MATA SEGOVIA) and his reality front www.essenciality.com since January 2013. Quotes and links below.

I have personally notified the Canadian and US Consulates, filed a complaint with Profeco (Mexico's Consumer Protection Agency) and testified at the Fiscalia General del Estado (State Attorney General's Office) to investigate and prosecute Mata on fraud charges.

If you've had dealings with Frank Mata, please comment here: http://www.tripadvisor.com/ShowTopic-g154267-i323-k8089032-FRAUD_ALERT_Frank_Mata_and_Essenciality_nightmare_stories-Nuevo_Vallarta_Pacific_Coast.html

A few of the nightmare stories:

"My wife and I rented 1 condo for 3 weeks for $1800 USD in Acqua Flamingos Nuevo Vallarta, when we arrived the unit was a mess, no towels, no sheets, no air conditioning, filthy cupboards and washrooms. After 3 days somebody showed up with the police alleging they were the legal owner of the unit, they showed their title and said that he never authorized anybody to rent the unit. We were immediately escorted off the property which was very disgracing and shameful. As we were not able to reach Frank Mata we had to book a hotel."

"A man from Essentially Rentals named Frank Mata took a deposit of $3,000 for a penthouse rent in the Grand Venetian, Puerto Vallarta. He gave us confirmation codes an when we got to the hotel there was no reservation and the codes were invalid. Frank Mata did not return my call so I went to face him. When I arrived to his office he pretended not to know me and called the security. I called him the next day, he picked up the phone and threatened me! Please do not rent from his company, it is a scam!"

"I lost a $500 damage deposit on a unit that I actually left spotless. Mata claimed there was physical damage to the place and when I asked for photos he stopped picking up the phone and replying emails."

"I rented a place from Frank Mata for 3 months in Punta de Mita mexico. He continually tried to add on extra charges like charging me for electricity when it was clearly included in the contract and adding on extra days. He now refuses to give me back my damage deposit."

"I have been trying ever since we got home at the end of March to get my damage deposit back. I have called him numerous time in the beginning, and almost everyday in the last month. He keeps telling me that he is going to send it when I could get a hold of him, and then he would not answer his phone, and occasionally when I would get a hold of him he would ALWAYS come up with some excuse. The man is a liar and a cheat and he has absolutely no conscience whatsoever, I am absolutely beside myself with this experience and will never go though a rental agency again."

"We used Frank Mata from Essenciality Property Manager. Frank was a horrible property manager and caused us a lot of grief but the place was also something out of a horror movie."

"The owner of the second place walked in on us after we had moved in. She didn't even know that we were staying at her place even though I had paid administration $1500 for the 3 weeks!"

"They stole my money with a fake papers saying that I didn't show up in time for a unit that I rented in Peninsula."

"I recently rented an apartment in Punta de Mita, Mexico from the property management company called Essenciality. I paid a damage deposit of 500USD and after 40 days I have yet to get it back and the owner, has stopped answering my phone calls and emails. Is there anything I can do? Just as a warning to other people renting in the area the mans name is Frank Mata."

"I rented a condo in Peninsula ,when I ask my deposit back he was never in is office, I made at list 25 phone calls and 45 e-mails. No answers. I give up. Essentially and Frank Mata are a fraud. Avoid their services."
