Fleetmatics has fired Jason Profeta, Web Manager of Tempe Arizona office in an attempt to quiet EEOC and sexual harrassment claims. They ignored his behavior for years, allowing him to bully and harrass employees at will. Several more claims are being processed in Arizona, as well as those to come in Illinois. I was recently contacted by an attorney representing an employee in Phoenix asking if I would join in a class action suit against the company and John Goggin, EVP of Fleetmatics. Anyone else out there had the same experience?
I worked for Fleetmatics and during my employ they RECORDED ALL the CALLS we made out-bound AND the calls we received in-bound. This is UNLAWFUL in FL and have been told not only can this give rise to a CIVIL SUIT by the ""INJURED PARTY"" but also CRIMINAL PROSECUTION.
I don't have a law degree, but have been told this by NUMEROUS LAW ENFORCEMENT AGENCIES I contacted to REPORT this ""activity"" the first report August 2nd 2010 filed with the FCC.
While working for Fleetmatics we were given scripts to make calls out to other businesses to try and set appointments for on line demos resulting in these companies purchasing our software. NEVER EVER DID the SCRIPTS say WE WERE RECORDING CALLS no OPT OUT- NO NOTHING! I have documentation.
IN FACT we were REPRIMANDED if we even stated we were calling from FLEETMATICS. Management didn't want the companies to know who we were. We would say we were ""working with"" another company similar to the company we solicited. DECEPTION!
The manager held a meeting one Monday to tell us he had over heard some of us saying Fleetmatics and FLEETMATICS was NOT part of the SCRIPT! He said if he heard us say Fleetmatics he wouldn't fire us BUT he would kill us. He thought that was funny, however we got the message LOUD AND CLEAR. MORE DECEPTION!
If that wasn't bad enough they RECORDED the calls DURING the on line demos. This is when if the potential client wanted to buy our product would GIVE CREDIT CARD/ACH and other sensitive information. MORE DECEPTION!
HOW was this RECORDED informationused going to be used???? This company AFTER repeated CALLS TO AUTHORITIES- COMPLAINTS FILED covered-up, LIED TO POLICE and INSTALLED a NEW PHONE SYSTEM! I had to witness this""cover-up""
BEWARE OF FLEETMATICS they may be TRACKING MORE than your COMPANY FLEET!!!!!!!
WELL known JERRY DYAS per his own admission to the ST PETE TIMES is a 25 year plus MEMBER of the CHURCH of SCIENTOLOGY and top executive with FLEETMATICS. I worked for this company and there were WHISPERS of this company being connected to the CHURCH. Ira Friedman a closer at Fleetmatics is a past member & possible current member. Just google monies paid to the Church and who paid. You will find hundreds of names and the money they ""donated""
If any employee didn't like the way they operated they could leave, or be fired.
Was Fleetmaticss using the same PRACTICES of the CHURCH to get NON- SUSPECTING business owners to divulge personal information/credit card/ach information maybe to use for recruitment purposes?
It has been reported to numerous authorities this company RECORDED CALLS WITHOUT THE CONSENT of the business owners. WHY? What was FLEETMATICS GOING TO DO - OR HAS DONE WITH THIS INFORMATION???
All the employees working there NEVER disclosed the call was RECORDED, not even during the on line demos with the closers when the closers took CREDIT CARD/ACH and personal information about the company.
FLEETMATICS liken to the CHURCH of SCIENTOLOGY(as evidenced by former CHURCH members reporting abusive behavior to the media) used CONTROL. POWER. DECEPTION and the use of 'plastic""- credit cards to close the deal in full. Just like the CHURCH acknowledged once again to the St Pete times Credit cards sealed the deal MUCH QUICKER.
This could all be hearsay, but seems coincidental that FLEETMATICS like the church with all its power and money could record these call without disclosure then COVER UP the crime. WHAT IS NOT hearsay the CALLS WERE RECORDED and AUTHORITIES are investigating.
Investors gave 68 million $ to FLEETMATICS. Thats a lot of money to IGNORE THE LAW. RECORDING CALLS IN FL without DISCLOSING IS ILLEGAL IN FL.
E-mail sent to Fleetmatics regarding hiring process. Some names removed for privacy reasons. Response from HR and my response back below.
These e-mails were sent to ALL of Fleetmatics top management team, but only Jorge from HR responded, though he did copy everyone - which means they all accept and acknowledge his reply.
Dear Fleetmatics Leadership Team,
Back at the begging of December 2012, I applied for a business development manager position in your Charlotte office. A man named ****** over at ***** which seems to be a staffing agency was handling the initial hiring process. After speaking with him, he set up an interview with *****, HR Generalist / Recruiter on December 18th 2012. After speaking with *****, he felt that I might be a better fit for the director of sales position that had just opened up in the Charlotte office. He said that he would contact Christian Horne and set up an interview. I alerted ***** of the discussion and he stated that he would contact Christian as well. After following up with ***** on several occasions, I finally decided to e-mail Christian myself. I was unable to locate any contact information on him easily, but I finally came across his e-mail address on the internet. On January 15th, I sent Christian an e-mail directly mentioning the conversation between ***** and myself along with the conversations I had with ***** over at *****. As of today, I have not received a response. As I mentioned to ***** in my original e-mail to him on December 18th, thanking him for his time, I asked him to contact me if the director of sales position wasn't available as I would still be interested in the business development manager position. That position was just listed on LinkedIn again yesterday, so I would assume it must still be available.
Today is January 30th, 57 days from the initial contact on December 4th with *****, and I have yet to hear anything, let alone an update. Even in the numerous e-mails I've sent, the only response has been from ***** telling me he's trying to get a hold of Christian, and that no one at Fleetmatics is easily reachable. Now I know from being in sales, and running my own sales teams and departments, that's a very poor excuse. It also reflects poorly on the management techniques in either the local office, or regional managers, if not further up the chain. I consider myself extremely professional, and took the time to research the Fleetmatics product and company in hopes I'd at least have the opportunity to present myself and what I have to offer, but that has not happened and the outlook seems extremely low. While I do understand that by writing this e-mail, I'm most likely shooting myself in the foot with any possible chance of an interview, I figure those chances were never actually available in the first place so I'm not really losing anything.
This e-mail is not meant to come off as someone who is angry by the process, it's strictly for information purposes. While I may not work for the company, I hope that this shines a light on the process I experienced and hopefully it can be used to adapt a new process or make the corrections needed for future applicants. Also, I'm sure you are well aware of the postings on www.ripoffreport.com regarding the Charlotte office, but when reading them, one can certainly understand the frustration and experience I received in attempting to get interview, let alone work in that office.
I wish you all the best of luck and thank you for your valuable time.
From Jorge Diaz - Senior Vice President, Global Human Resources - Fleetmatics
This email will confirm that we have received your email and feedback. Although I cant speak to the facts of the situation you are referring to, I certainly will make a few points
We have no formal affiliation with ***** and the ***** firm. That is a recruiting firm that has referred candidates in the past, but they do not represent or speak for Fleetmatics.
Although I sense your frustration with the process and lack of communication, I would encourage you to take a different approach in future job pursuits. We certainly welcome feedback, especially the kind that we can use to become stronger as a company. Although I dont know the nature of why you didnt receive the kind of communications you expected, I will take accountability on behalf of the company and apologize for any gaps in our process that may have affected you. Your options to raise this matter perhaps could have included an attempt to contact me as the head of Human Resources in an attempt to get an answer. Instead you sent this feedback to a broad set of executives in the company. Your approach reflects on you and how you might approach problem solving in the future. For this, I agree that there is no point in continuing your pursuit of a position with Fleetmatics.
Thank you again for your feedback and best of luck in your job search.
E-mail back to Jorge and the upper management team:
Jorge,
Thank you for the prompt reply and confirmation of my comments.
As I mentioned, this is usually not the route I would take, or would ever think of attempting, but after the process, and e-mails to both ***** & Christian Horne, I got the feeling that this was how business is done around Fleetmatics. Also, the listing of the position was posted and maintained by *****. I was under the impression the entire time, that this was his job with Fleetmatics - to find and set up interviews of potential candidates.
Last but not least, in this case, I find it extremely fitting to not only alarm you, but other senior management members of my experience. While I have no doubt you may have been able to handle the situation, this is something everyone in charge of running the company should know. From the sound of your reply, it sounds that you would prefer to keep something like this out of view from others and frown upon someone coming forward with an issue. If I am not mistaken, that's one of the duties of an HR department - handling negative issues in regards to the company and it's employees. As unprofessional as you may think I am, I certainly think you response back to me was in the same ""unprofessional"" manner that my original e-mail may have been sent in.
Once again, I thank you for your time and prompt reply and hope that some of my experience results in changes for future applicants.
I worked for Fleetmatics for 3 1/2 months. I along with another female employee had to share a bathroom with the other 30+ men that work there. There is a constant barrage of F Bombs, sex & drug talk...upper management refused to do anything and told me to quit if I didn't like it...after contacting the ""HR"" person there was an ""investigation"" & they acknowledge there were issues. Then came the retaliation...changing up our lead process, refusing to teach us to close when other men with far less time (3 weeks) were training (hands on) & allowing to close aka Make More Money....this company makes outbound calls to multiple states and was recording calls for the closers to review & coaching opportunity. Trouble is Florida is a two party state: meaning you must tell the party the call may be monitored or recorded. I reported this ""oversight"" to HR, State Attorney & local authorities. Jerry Dyas (per Vince at local Clearwater PD) told officer on 11/18 at 12:30pm that they hadn't recorded in 30 days due to software issues. That sounds like an admission doesn't it? Anyway...Jerry Dyas had a ""new"" phone system installed on 12/16. Fleetmatics has an office in Chicago, Ill. Another 2 party state; An instructional video of a prospect in Arlington Heights, Ill was circulated. The prospect did not know he was being recorded.
I along with another co-worker filed with the EEOC for Sex & Retaliation on 12/5 & 12/7. I am the top producer this month...top 3 every month I was there. On 12/12 I forwarded an email to Al Vasile outlining the ""two party state of Illinois"" ; On 12/13 at 1:30pm I was terminated by Al Vasile with David Brown present. Reason Given: You are unhappy. I could tell when you sent me that email yesterday.
I have documentation after documentation regarding vulgar language, sex talk & retaliation to myself and the other employee. This company has absolutely NO REGARD or RESPECT for women. They act as if they are above the law.
