I just recently been hit with a garnishment as of January 2013. Prior to this month, I had just been informed by my HR department of this garnishment on December 21st 2013.
Prior to the above mentioned dates, I did not even know that I was even expected to had been in court on April 17th 2009. I never received any papers for this Complaint on an Unlawful Detainer, my rent was paid up to date so I wouldn't have had a reason not to attend.
In addition, I never received a 3- day notice to pay or quit. I'm not even on the lease agreement, so how I became involved is besides me. I filed a motion to have this case reheard in front of the judge so that I could have the opportunit to explain and enter in all the facts I had in regards to this false complaint being placed by the landlord (Jose J. Ochao) of OC Property Management.
This is the gentleman that was renting out the property for Lillian Lopez. On February 12th 2009 there was a notice placed on the door indicating that anyone dwelling onthis property has 5 days from the time of this notice dated 02/12/2009 to be off the property for the property is to be auctioned off by the bank on 02/17/2009.
I was able to purchase a sealed stamped Notice of Trustee's Sale & Notice of Deed upon Sale. I also was prepared to submit proof that I did not maintain residency at the property,my children were both enrolled in High School so I had received a school information records for both my children indicating their home address.
Unfortunately, because my case was so old the judge would not hear my explanation or look at the documents that I had gathered up. He just kept on saying that, I should have shown up to court to plead my case, Like really? How do you appear on a case that you have no knowledge that it even existed?
This has really caused a great deal of hardship and financial strain on me and my two children. They even made the assumption that my last name was the same as my finace's at the time. This is because I was never on the lease nor was I added after the fact. I still have the lease agreement that the landlord submitted to his attorney showing that I'm no where on this lease.
My only mistake was that I paid with cash and did not keep my receipts. However, it probably wouldn't have made a difference since the jusge didn't want to hear me out anyways. Besides, who keeps receipts from a previous address that you lived at 4 years after you moved out? This is when I found out about this eviction placed on my credit & garnishment that was being held from my paychecks.
So here I am, asking for my credit union to honor a loan application that I submitted so that I could negotiate with a law office who never even had me served. I just happen to stumble across this website when I was searching for the attorney's address & phone number to negotiate with.
What a lesson to learn "Can't trust the justice system in any situation, because too many inocent hard working tax payers end up losing in the end".
I guess I'll have to chop this one up as a lost and just pay the $10,000 that I don't honestly owe?
