On or about June 15, 2012, landlord/co-owner Kenneth N. Mitsche of EMAC Real Estate Services Inc., P.O. Box 510694, Milwaukee, WI 53202, came into my place of employment. To inform me that landlord/co-owner Kenneth N. Mitsche & landlord/co-owners Abel & Erica McNamara of EMAC Real Estate Services Inc. recently went into business together and bought the rental property located at the following address: 2462 S. Howell Ave., Milwaukee, WI 53207. Landlord/co-owner Kenneth N. Mitsche handed me his business card and asked me if I was looking for a studio apartment to rent. Because, he had one available for $450.00. (four hundred and fifty dollars and no cents) with gas, water, and eclectic included.
Before I paid my cash deposit to landlord/co-owner Kenneth N. Mitsche failed to disclose he was renting out an illegal improvised living area in his basement. Landlord/co-owner Kenneth N. Mitsche did state there were no separate controls to the central air thermostat setting in the illegal improvised living area in his basement. He stated the central air was a bonus feature of the illegal improvised living area in his basement. Landlord/co-owner Kenneth N. Mitsche stated I could control the central air by opening and closing the vents in the illegal improvised living area in his basement.
Landlord/co-owner Kenneth N. Mitsche failed to disclose the illegally installed mechanical, electrical, and plumbing systems serving the illegal improvised living area in his basement. On or about July 11, 2012, I paid landlord/co-owner Kenneth N. Mitsche cash in the amount of $1,125.00. (one thousand one hundred and twenty-five dollars and no cents) for the security deposit, half of July 2012 rent, and August 2012 rent. I drafted the receipt myself before I met with landlord/co-owner Kenneth N. Mitsche. Because, when I gave him my cash deposit landlord/co-owner Kenneth N. Mitsche did not have a receipt book.
I asked him don’t I have to sign a lease with you? Landlord/co-owner Kenneth N. Mitsche said he did not have time to go through all the paperwork. At that time landlord/co-owner Kenneth N. Mitsche failed to provide me with a move-in inspection check list. According to landlord/co-owner Abel McNamara normally EMAC Real Estate Services Inc. provides each tenant with a standard lease to sign.
On or about August 21, 2012, a Code Enforcement Inspector for the City of Milwaukee Department of Neighborhood Services physically handed me the 7 Day Notice to Vacate the uninhabitable illegal basement unit. The 7 Day Notice to Vacate specifically orders:
“Discontinue use of basement as habitable space. No second means of egress. Illegal occupancy and use. Disassemble improvised living area. Remove bed, tables, clothing, and all other evidentiary items in basement. Illegal basement living. Remove all illegally installed mechanical, electrical, & plumbing systems serving illegal basement unit. Remove interior partitions (non-load bearing) and restore basement to an unoccupied basement serving only the other legal units.”
Landlord/co-owners Abel & Erica McNamara & landlord/co-owner Kenneth N. Mitsche own several rental properties throughout Milwaukee, Wisconsin. After the Code Enforcement Inspector physically handed me the 7 Day Notice to Vacated the uninhabitable illegal basement unit landlord/co-owners Abel & Erica McNamara & landlord/co-owner Kenneth N. Mitsche did not offer me a different rental unit or try to remedy in anyway the fact I would be homeless in 7 days.
On my behalf the Code Enforcement Inspector contacted landlord/co-owners Abel & Erica McNamara & landlord/co-owner Kenneth N. Mitsche to negotiate the return of my security deposit. Code Enforcement Inspector John Kolberg informed landlord/co-owners Abel & Erica McNamara that it was unlawful for landlord/co-owner Kenneth N. Mitsche to knowingly rent out an uninhabitable illegal basement unit as habitable space. Landlord/co-owners Abel & Erica McNamara verbally agreed with Code Enforcement Inspector to return $1,200.00. (one thousand two hundred dollars and no cents) for my security deposit, for the cleaning, for the supplies I bought, and for the repairs I did in exchange for September 2012 rent.
The Code Enforcement Inspector arraigned 2 meetings with lord/co-owner Abel McNamara & landlord/co-owner Kenneth N. Mitsche to return the $1,200.00. (one thousand two hundred dollars and no cents). On 2 separate occasions Abel McNamara & landlord/co-owner Kenneth N. Mitsche were a no call no show.
On or about September 10, 2012, landlord/co-owner Abel McNamara stated he is not responsible for the return of my security deposit or the damages I suffered as the direct result of his intentional grows negligent actions. Landlord/co-owner Abel McNamara also stated he did not want any further contact with me and I was told to contact his Attorney James R. It is my understanding that landlord/co-owner Kenneth N. Mitsche & landlord/co-owners Abel & Erica McNamara were running a landlord/tenant scam. Together landlord/co-owner Kenneth N.
