17 February 2015, after signing a contract to begin masonry work and setting a date to begin, Mr. Di Spirito asked for over $800 up front to buy materials. I was very leery of handing any money out but was convinced by Mr. Di Spirito I gave Mr. Di Spirito the $800 and he never showed up the following week to start the job. When I called Mr. Di Spirito and asked for materials he said everything was on control. Passed the whole of February and March and no job start. I texted him and calling asked him what is the status of the job and materials and he said that he have problems getting the pavers. On 5-6 March 2015, He texted us that he was coming to start the job and never showed up. I called him and stated his son has problems. 6 March 2015 he never showed up and told me was on doctor appointment with son. 9 March 2015 stated was coming, I called him, stated that was behind in another job. The next day he said have problems with a toilet installation. Came over 10 March 2015, stop by 30 minutes dig on the patio and left because had a tire problem since the date never return. I texted him several times and told me have problems with his truck, he stated was going come over nothing happened. I texted around 3pm if he was going to come over never happened. He send a text to my wife NO NEED TO CALL ME EVERY DAY. I told him I need the job done by 20 March 2015 cause I’ve a event on my house and I can’t leave a whole in the patio. He was supposed to build pavers of 100 sq ft with a fire pit. I called every single place in city to find out he bought the pavers and no records that he purchase the pavers. One of the places I was searching for the pavers to help him to put on hold for him told me that Mr. Dispirito has been doing the same to a lot people in the city. I found the pavers for him and told him the lady was holding for him to pay and pick up. Monday 16 March 2015 the store lady told me he called and told them NOT to hold anything.19 March 2015 at 6PM, my husband called him asked for our refund and he told us that we should receive by 20 March 2015, which never happened. 30 March 2015 he texted my wife stated he SEND the check by mail. Up today we never received the refund check. I called him and he stated to me that he never told to my wife send a check refund. I asked him to bring me the money and Mr Dispirito up today don’t have any intention to refund out money. my money back he said he would send it. Weeks went by and no money returned. I called Mr. Di Spirito on several occasions and he would not respond. I have never received a refund from Mr. Di Spirito. Mr. Dispirito has a distorted view on the events that occurred.
On July 17th 2014, I contracted with John Di Spirito (DI SPIRITO MASONRY & TILE) to Lay tile in my screened room. He came to my home and gave me an estimate. We agreed to his price and gave him a $300 deposit by check ( Which he cashed ). He was supposed to start the job the following Monday. Monday came no calls from him. I called him, he said he was delayed on his current job and would be here Tuesday. Tuesday came he did not. I called he said he was delayed by the rain and would be here Wednesday. Wednesday came no calls from him. I have not been able to reach him. There is no answer at the number he gave me. I left numerous messages. I sent him e-mails asking what happened. Again no response. He clearly does not intend to do the job.
