I contacted Creekside forest on August 15. I was relocating my kids and I to Georgia from Louisiana, and was looking for an immediate move in. I was advised by Shan, one of the leasing agents, to Western Union my administrative and application fee, and that it would hold my unit until I got there the last week of August. In desperate need, and knowing that I could keep track of the transaction and the receiver by the confirmation number, I did.
I arrived in Georgia August 23rd, expecting to move in the next day. The office was closed, the next day was Sunday. Monday I contact the office and was told the apartment wouldn't be ready until September 1st. This forced me to go to my nearest family members house in covington ga. September 1st I contact the apartment complex for proof of residency and a unit number so I could get lights set up. I was emailed a front page of my future lease. I contacted Georgia power and was told power was recently set up in that unit under a different name. I immediately contacted the apartment complex, who acted as if they didn't know they had given the unit away. I was put on a brief hold, then told that I would get a call back.
My kids started school on Sept 8, a week after my last move in date. Their school is 5 min away from the apartment that i paid for and was assigned, 7 minutes with traffic. However, since it wasn't ready, I was forced to drive back and forth from covington ga, a 30 min drive 4 times a day. I have to drive to Decatur to drop them off at school, back to Covington Georgia, then back to Decatur to pick them up, then back home to covington. I continuously called the apartment complex to put a rush on another unit. The commute is costing me 20$ verses 3$.
My move in date was pushed back to September 21st then September 26. On September 26, my grandmother and I went to the apartment complex to see my unit (202) and get keys. No one had any information other than the unit was not ready and that they would try their hardest to get it ready. They promised to have it ready for move in by October 1st. I asked to at least see the unit, since I had no idea what the layout looked like. I was told no.
October 1st I went to the office, ready to move in. I was advised the unit was still not ready. There was also someone else in the office waiting for keys to an unfinished unit. My unit was so incomplete that they could not show it to me. Instead, they took me to someone else's unit (207) to show me the layout plan. That apartment was also unfinished. I demanded a refund once I was told the apartment could not be finished by the end of the day. I was advised to fill out a refund form by the property manager, Pat and ast. manager, shae. I was assured that I would receive a full refund and reimbursement for my storage facility for the month of September and October, (since i paid and have been waiting since August).
After days of getting the run around and checking the status of my refund, I finally spoke with someone from corporate office on Oct 11. I was advised that I would not get a refund because Creekside forest advised them that I turned down 3 ready units. I immediately called creekside forest, who denied those statements and reassured me that they are aware that they couldn't get a unit ready, and that the first one was given away days after it was assigned to me, without notice.
I went to creekside forest to speak in person about the incident. Pam informed me that she spoke with Kim from the corporate office who stated, she isn't budging, and started asking questions as to why I paid in August and had yet to move in October. I was also informed that Kim stated since 30 days had pasted by, I would need to pay again. I was told by the leasing agents they covered up the fact that they had taken my money in August and had yet to give me keys. However, they did not tell Kim that they told me to send my money in August to secure a unit, but still did not have a unit ready.
I was told to seek legal advise. I called the Secretary of State to find out their registered agents name. Absolutely no file comes up for creekside forest. I had to provide their former name, candler crossings. Duluth Georgia came up as the registered agents location. So, of course i had to go to that county's courthouse, 45 minutes away. I filled a small claims. However, the sheriff could not serve them because they "Are not the register agent for that company". When I gave the Secretary of state their other property name (which is also their corporate office) Lakeview trails, nothing showed up. I have yet to speak with any decision makers from corporate. They won't return any calls or release their registered agents contact information. However, I did keep all of my proof, call records, and documentation.
So far they have cost me 480 in their fees, 140 in storage fees, 100$ a week in gas for 8 weeks and counting (school commute) and a great deal of inconvenience and instability for my kids and i
