We are a biomedical equipment repair and sales company that had a contract with COASTAL MEDICAL IMAGING CONSULTANTS LLC based out of San Diego CA for the purchase of 2003 Flouroscan C-arm for a total of $13,000.
The original agreement was half down and half at delivery. We had to give a down payment to hold the unit of $1000 and then to purchase we wired $7000 before shipment and mailed a check for the $5000 remainder due upon delivery. After the check was in the mail COASTAL MEDICAL IMAGING CONSULTANTS LLC stated that they could not ship the unit unless they could deposit the check. We had told COASTAL MEDICAL IMAGING CONSULTANTS LLC that the money would not be in the bank to clear the $5000 check for a week but the sales man insisted that they must or he could lose his job. We watched for the check to come in and once the bank went negative $200 we thought everything was fine and the bank had cleared the check.
We had a pickup scheduled from a freight company for that Friday to pickup from CA and deliver to our customer in SC. On that Thursday before pickup Rich Cabral called stating that the check bounced and that he was going to be fired over this. We scrambled and were able to wire the $5000 owed plus a $36 bounce check charge (for our check) and another $36 fee that Mr. Cabral stated that he incurred from the check bouncing. We had this issue corrected in less than three days and even paid 2 bounce fees for Mr. Cabral.
The next Week the C-arm arrived at a cost of $750 in freight we drove the two hours to install the unit for our customer and found that they sent a much older unit that was only worth about $2000. We called Mr. Cabral and he told us another sales person sold that unit by mistake, the warehouse worker thought that unit was what he sold and that he would fix it.
The next day Mr. Cabral told us he was fired over this. (For not following company protocol.) We asked several times for the phone number and Mr. Cabral denied giving it to us. At this point we started to look up the LLC paperwork filed for CA and found that in fact Mr. Cabral owns this business and lied to us about being fired. We called and talked to Mr. Cabral and he apologized for lying stating that he was trying to buy time to fix this. We told Mr. Cabral that we could work with him by taking payments and even could possibly sell this junky unit to make him two sells instead of one and he told me that he could sell it to me for $6500… Still well more than it was worth but at this point we were just trying to get our money, so we accepted. It has been well over a month since then and Mr. Cabral or his company COASTAL MEDICAL IMAGING CONSULTANTS LLC has not paid us back one cent.
To fulfill our contract with the Dr. we were forced to purchase another C-arm from another company that was comparable to what was promised. Pay Yet again for shipping and drive the two hours to install the unit.
COASTAL MEDICAL IMAGING CONSULTANTS LLC has stated that before we receive a penny we must pay for and ship back the C-arm that was sent or give their company $6500 for it when we have already given them $13,000 and recieved a $2000 unit... The old bait and switch...
