Police Department Sued For Fatally Shooting Unarmed Man

The mother of a man killed last year by a Port Hueneme police officer has filed a federal wrongful death lawsuit, alleging authorities reacted improperly when they fatally shot her unarmed son and left him for dead.

Eileen Ramirez of Oxnard claims police acted negligently in the death of Jose Luis Ramirez, 18, who was shot in the head, a lung and a pinkie finger on Nov. 19, 2011 in the 900 block of Redwood Street in Oxnard. Ramirez died five days later at the Ventura County Medical Center of a gunshot wound to the head, officials said.

The suit was filed last month in U.S. District Court against the cities of Port Hueneme and Oxnard, the Port Hueneme and Oxnard police departments and the officers involved. Eileen Ramirez is seeking unspecified damages. The suit claims Ramirez's civil rights were violated and accuses officers of using excessive force and of acting with deliberate indifference to his medical needs. It also claims the departments were negligent in their hiring and training standards.

PORT HUENEME, Calif. (KABC) -- An investigation is underway in Port Hueneme after a fatal officer-involved shooting early Friday morning. It began with a traffic collision and ended with gunfire.

The massive crime scene shut down a parking lot of Port Hueneme's beach park.

Authorities responded to a traffic collision in the 500 block of East Surfside Drive at 4:13 a.m. Shortly after the officers arrived, shots were fired.

""A short while after they arrived on scene, they requested the assistance because shots were being fired,"" said Port Hueneme Police Sgt. Peter Freiberg.

The suspect was pronounced dead at the scene. A name has not been released pending notification of next of kin. It was unclear if a gun was recovered at the scene.

""He's always parked his truck up here at night and in the morning,"" said Donni Perez of Port Hueneme.

Both police officers involved in the shooting will be on paid leave pending the outcome of the investigation. This is the first officer-involved shooting for Port Hueneme police this year. They only had one last year.

You people are idiots - you go by what people say - he was not homeless - he was a videographer who spend many days filming there - he NEVER carried any sort of weapon - I have known Mike for more than 35 years - he was a star athlete in HS, worked many many years as Sylvester Stallones body guard - a former Golden Glove Champ - filmed many red carpet events and a respectful decent man - HE WAS NOT ARMED - you need to get your stories straight and get the bozos off the camera that seek their 15 minutes of fame!

Transient - yeah nice truck for a homeless man - you fools believe anything, he would sit on the beach, make and edit his videos - HE loved the beach, it gave him peace - look at his videos on his facebook, they are 99% taken at that specific beach - they wont find a gun either unless it is planted - cause Mike didnt believe in guns - Trigger happy officers was the problem here - I doubt he did anything to justify being shot 5 times - 4 shots in succession then later another shot - ALL of the shots fired were from those officers - Ventura county has a reputation for this type of brutal force - 6th one this year - and hopefully another wrongful death suit on its way. Hope those officers rot in hell

If this station wants real news then go out and investigate this whole scenario..Where are any of the details?????.And the officers are on paid leave Why??? Why not investigate first? This is an outrage....This was no way for our friend to die...He wasnt some lowlife substance abuser or bully...He was well loved and a kind thoughful guy...And this is coming from New York City....WE WANT ANSWERS!!!! Get out there and investigate and let us see the real story not these bits and pieces of nonsense....He deserves that much since he was the one riddled with holes!!!!!

The police have some explaining to do, and I might suggest that all video (police cams, etc) be made available to the public. There is no reason this man should have been shot short of an over zealous officer making a grave error in judgement.

Mike ""The Duke"" Deluca was a great man and a local celebrity NOT a transient his girlfriend lived across the street and he was waiting for her. Hollywood is reeling over this tragedy people are enraged and want justice served now. His family devastated a pain that will never go away for everyone that loved Mike Deluca. The cops that killed this phenomenal human being are going to prison for the rest of their lives. The cops that killed him are violent criminals with badges, the most dangerous people on earth, unfortunately Mike happened to come across them who will be next? HE WAS UNARMED!!!
