I was at the light at Time Square when a cop just crossed the road infront of me. As he crossed the road, he saw my phone on my lap he turned around knocking my window that why was I using my phone. I told him I was not using it was just sitting on my lap. He lied to me that he saw me when I drove from one light before that I was holding a phone. I also picked up the phone and showed me that look at it the screen is locked and I wasnt doing anything at all.
The truth is I was never holding a phone. My car has a bluetooth and my phone is always connected so I can operate my phone using my car so I dont have to physically hold a phone to operate it.
The cop also lied because he never saw anything, cuz if he had seen me from one light before, he would have waived and stopped me but in reality he just crossed by and saw the phone on my lap from the window. My having a phone in the lap was unusual but doesnt still doesnt mean I was using it or even holding it.
He took my license away and asked me to clear the light and park next to the curb. I did that. When he came to me, I showed me that my phone was connected to the car and he is mistaken that I was using it or even holding it. He asked me for insurance and registration and while i tried to explain to him he raised is voice loud at me as if I was a criminal or something. He started yelling at me that dont argue with me.
I will definietely Plead NOT GUILTY and I will fight this case tooth and nail to the end. I am not very hopeful, because I really doubt the legal system of New York. I know they just listen to what the cop says and believe it. I will try and ask the judge if he can get the survaillance cameras evidence from that day and see for himself that I was not holding the phone and put the cop behind bars for lying under penalty of perjury. Wishful thinking, I know this aint gona happen. But I will fight it.
If anybody can help me and let me know if I can bring a lawsuit agianst NYPD for this ? Is there a law where an officer is accountable to the false statements they make while handing out tickets?
Discrepancies in the posting/salient points of contention:
1) The odometer statements on this truck are not correct. The odometer statement reads exactly what the ad posted on ebay did of 154416 miles however, I recieved the truck with154721 miles on the odometer. I did drive the vehicle from the drop point at 8720 Shaver Rd in Portage MI to my home at 1009 Treasure Island Dr. in Mattawan, MI. A trip of 8.62 miles according to mapquest. That is a descrepancy of 305 miles. The Excursion currently has 154729 miles on it and has not moved from my property since I collected it.

A: Hello, To be 100% honest to you, this vehicle looks and drives like it has 20k on it. Don't be alarmed, as the vehicle WAS NOT a police vehicle. There was an optional POLICE INTERCEPTOR package that came on Fords. I believe the previous owner just placed the emblem on the vehicle as I can not find any other POLICE INTERCEPTOR Excursions anywhere. It mostly came on Ford Crown Victorias. 3) I was mislead in the purchase of the excursion. I asked the question of the dealership if the vehicle has rust or leaks, they said it did not, both in writing and on the phone. Their ad reads that the vehicle does not have rust or any leaks. The vehicle does in fact have rust. It does have leaks apparently the transmission and the radiator both are leaking.
4) They advertised it with brand new tires. They are not.
5) They advertised the interior on this vehicle as nearly flawless. It is not.
6) I was told, by Sam, on the phone that he could not belive how good the condition of the truck was that the paint was all original and that it almost looked brand new. The photos that they posted on the internet show a very near flawless vehicle. I belive they photoshoped and shot around the damage on the vehicle as my photos show.
4) I knowingly paid $9000.00 that is $1125.00 over NADA retail for this truck based on the description of the condition of the truck. I was mislead. The photos show clearly that I bought a rough book truck at best. The difference between a rough book truck and a retail book truck plus the $1125.00 I paid over retail is a total of $5650.00. If I would have known the transmission was leaking, the radiator was leaking, the paint was spider webbed and cracked, there was rust on the vehicle, that the tires did in fact have use and wear on them, the sunroof did not open, the powerdoor locks did not work... I would not have purchased this truck at any number let alone the $3350.00 NADA rough book value.
7) Additionally, I have taken out a loan for the purchase of this truck. I have not depositied the check back into my account.
8) I purchased full coverage insurance on it.
9) I put $118.00 of gas in it when I picked it up at approx 10 pm on the 10th of October.
10) It was dark when I left the house the next morning so I did not notice the flaws in the paint nor the growing oil stain from the transmission fluid on my driveway. (Liability for damage to my brand new driveway?)
11) I called Chase Auto Group on the 11th of October to let him know that there were concerns with the truck and what would he suggest. Stated that Sam may take the truck back and he would call me later.
12) Confirmed that Sam would take the truck back all I need to do was ship it back to him.
13) Later, Ron stated Sam didn't want to do anything but I should call back tomorrow and maybe Sam would be in a "better mood".
14) Later, Sam stated he would take the Excursion back but it would be at $2000 - $3000 less than what I paid for it. (Sam and Ron have been "backing off" from what they say instead of "standing behind" their cars like their ads says)
I have attached photos and docs as well and while there is sufficient data here to win a court case in my opinion I feel our purpose is well suited to gather the additional information regarding the mechanical repairs needed (I am certain their are additional issues i was not able to uncover in my 15 minute drive home in the dark), the paint work and the appraised value of the vehicle by automotive professionals.
Brought a 2008 Dodge Caliber On 4/14/2014. A week after I had the car, a warning light came on in the car. Took out the owners manual find out it's the electronic throttle. Basically it's the fuel not getting to the excelurator. Went to dodge for an oil change, upon visual inspection, car needs brakes, rotors, shocks, struts, wheel ailment, oil pan leak. And a few other things. Total cost to let dealer fix, $2200.00. Went back to the dealer, nothing of course is under warranty, and if I give him $1100.00 he'll fix everything. Now I'm ok with normal maintaince on a vehicle. Not $2200 worth. Owner peter was not willing to negotiate. Don't buy from these people. Going to court!!!
