In late September 2010, I filled out a form on the Military.com website asking if I could use my VA to refinance my Texas Home Equity Loan. On or about October 6, 2010 Ms. Madison Moore from Brazos National Bank called me about refinancing my home equity loan by using my VA eligibility to get a VA loan. I explained to her that I did not have a first mortgage, that all I have is a home equity loan. She said it was absolutely possible and she had Colleen Fritz send me the VA application. I completed the application and started sending the requested documents for getting the loan. One of the documents that I sent her was a copy of my Texas Home Equity Loan with Randolph Brooks Federal Credit Union. Colleen pulled a copy of my VA eligibility certificate and said I was qualified for the VA loan. At some point Colleen turned me over to Donna Bagley to finish processing my loan. Donna told me the VA loan required me to get my house inspected for: termites, well water test, and septic system inspection. In addition to the inspections I paid for the VA appraisal, all of these came to a total of $730.00. In late October I was told I was approved and we would close the week of Thanksgiving because I was going on a three week trip starting November 1. The closing never happened, then during the first week of December, Jeff Guthrie, the head of their mortgage department called and said they had made a mistake and that I can't get a VA loan to refinance the home equity loan. He said the error wasnt caught until the loan was reviewed for final approval. I was upset because I had paid all this money and now he was telling me that it was wasted and he wouldn't reimburse me the money for the inspections. But he would give me the same interest rate and the bank would pay for a new appraisal for a conventional loan. He also said it would only take a week or so to get the loan approved and closed since we had done most of the work. Every week for the next few weeks he said we would close the following week, and the closing never happened. Finally the first week in January I called Matt Martin, Executive VP of the bank and he said the problem was my house appraised for $275, 500 for the VA loan; but only $237,000 for the conventional loan and that it was too low to give me the loan. He said he would try to get the appraiser to take another look at the appraisal and see it could go high enough to make the loan. But as of last Wednesday January 13, 2011 nothing happened. When I spoke with him on Monday January 11 I asked him to give me my money back and I would get a loan with another bank, he said we were so close and to give him more time. I told I would only give him another 24 hours because it had been over 90 days and he couldnt tell how much longer it would take to close my loan. I called him the next afternoon and told him I was cancelling but he wouldnt answer his phone. I sent him an email telling him to cancel my loan and refund my money. We exchanged emails and he final called me at around 4:00 PM, he kept to referring to our agreement to give him enough time to fix the issues and close the loan. He also started talking about us dealing man to man I guess he was saying that I am not a man because I filed complaints to the Better Business Bureau and the Texas Attorney General. I agreed to give him another 24 hours to fix the appraisal issue but I dont have any faith in him or his bank. Matthew finally cancelled my loan on January 13 after I sent him an email telling him that I would not attend the closing even if he the loan approved. At first he and Alan Kinesy said they would refund the $330.00 for the inspections but not the $400 for the VA appraisal because they would have charged me $425.00 for the conventional appraisal if we had closed the loan. I told them, I had not asked for a conventional loan and I had not approved the new appraisal, they offered it at no cost to keep my loan going. I finally told them to mail me the check for the $330, but now they refuse to give me any of my money back because I filed a BBB complaint. They are also disputing my telling them at the beginning of the loan process that I wanted to use my VA loan to refinance my Texas Home Equity Loan. Alan Kinsey said they are no longer responding to me and they are escalating my complaint to their chairman of the board and their legal department because I have disparaged their bank. I feel he is threatening to sue me because I am complaining to the BBB, Texas Attorney General, FTC, Military.com, and anyone else that will listen to my experience with their bank. I have been very critical of their bank because I have very reason because of the way they messed up my loan so badly and they have insulted me and my service to my country by treating me so shamefully, and robbing me of my time and money. I have written verifiable proof that within a week of starting the loan process I faxed them a copy of my Texas Home Equity Note and their staff verified they received it. I believe their loan officers either cant read or they dont have the knowledge to process VA loans. I wrote the VA and asked themto removeBrazos form the list of banks that can process VA loans because they clearly dont know how to process mine. I want any prospective military customers to know how Brazos National Bank has treated this veteran and probably many other veterans, and how incompetent they are at processing my VA loan.
