Bernadette Garcia sold my interest in a pony to Ms. Cindy Canace who signed an affidavit stating she knew I was the previous owner and made no attempt to try and contact me. The ponies name was changed back to a previous alias. I am not the only one who Bernadette Garcia has stolen from. She is involved in multiple lawsuits which involves pony theft and has stolen ponies hidden and renamed on her farm in Manorville, NY.
Bernadette Garcia goes by the aliases Bernadette Pupilla and Bernadette Pupilla Garcia. Her farm name has changed three times from Little Ripple Farm to Fox Tail Farm to Cassidy Hill Farm.
Upon reviewing the documents, only Bernadette Pupilla signed the Bill of Sale of High Hhonors also known as Dillinger.
Amber Hill Farm owned 25% and did not agree to the price of the pony and should have had to sign the Bill of Sale also. Bernadette did not have free and clear title to the partnership pony. Amber Hill Farm still owned 25% of the pony that is a papered sport horse, registered half welsh and by a famous stallion. There is no way I would have agreed to the price. Even in Bernadette Garcia's emails to me she stated he would be sold for more money, which I was not happy about because I knew of a much higher offer that was presented to Ms. Garcia at Pony Finals. Ms. Garcia refused that offer, without presenting the offer to me because she wanted more money for him. Ms Garcia became very belligerent and told me she would sell him for $1. I never received any consideration for the sale and my assistant has asked multiple times for a copy of the Bill of Sale which was never provided. I was never told he was sold and I discovered his name was changed to back to Dillinger. I was never even paid my 25% of the sale price. I have contacted both Bernadette Garcia and Cindy Canace and both admit I own 25% of Dillinger but Ms. Canace lawyered up immediately upon my notice and proof of my ownership interest. Ms. Canace has refused to let me send a veterinarian to give me a report on the pony and has refused to send pictures or video. Instead of going after Ms. Garcia, she reported me to the NJ police for harassing her? Ms. Garcia has sent me foul messages, emails and has posted derogatory things about me on Facebook. Ms. Garcia refuses communications with anyone.

It took me 9 months to find the pony. I was NEVER paid a penny for my 25% interest but instead Ms. Candace was through her lawyer stated I owed 25% of his training and board when I had no responsibility to share in expenses. They have no agreement stating this. The Bill of Sale from Amber Hill Farm transferring 75% of the pony states only profits will be paid upon sale. It does not account for expenses to be shared.
I presented all of this information to the USEF and they stated the transfer was valid evven though it is clear that the pony was not transferred properly as the top of the USEF Ownership affidavit states "If the Affidavi does not explain the lack of sugnatures of all recorded sellers, the transfer can not be processed without additional proof".
all not true.. ms manderino and cassidy hill farm had multiple conversations about the pony dillianger.He was swaped out for cassidy hills large pony ALMOST MIDNIGHT , a more superior pony. Almost might aka Blackie was raised and trained by Bernadette garcia. The pony suffered from EPM as a yearling and was treated by our vets to the best of our ability,,Ms manderino was told that the pony was a hard strong difficult ride and too tough for our children to ride.He was showing signs of nerological problems causing him to buck and excessively swish his tail. Ms manderino said " send the pony to her in the trade emma her daughter would be able to ride it". I explained to her that would be fine , but i had no funds to pay, she opted for the swap of her large.I told her that we would show the ponies till finals and re visit leases after that. I agreed to the 75 split but that blackie had issues and no sale or lease unless the potential buyers and or lessors were made aware of his history and why he swished his tail she agreed. I recieved high honors aka dillianger and on first sight inspection WE ALL NOTICED HIS EYE. I immediatly called ms manderino to tell her the pony had a white glaze over his pupil in his eye and seemed to not have sight out of it by simple tests.. Instaed of helping or showing one once of concern she faxed me a form that stated that all vet bill will be covered by me!! the pony was uncomfortable and the vet was called !! My vet had me call a specialist who came and did and extensive exam and treatment .the pony as stated by my specialist had this eye problem for a while, of course denyed by manderino . I asked her to swap back the ponies but she started with how much time and money she had into mine.(a month aporx)i could tell she was not going to be easy to deal with so continued the expensive treatment to clear up 80 percent of the eye and eliminate his pain. We tried to show jump the pony but his eye was a issue .. dirt sweat shadows and long days seemed to upset him..again I spoke with manderino and explained this was not right for the pony. jumping not his thing and i did not want to do this anymore to him. I told her I had some one comming to try him as a dressage pony.she asked what i could get for him i said ill find out. NOTE the pony was bred for dressage by ms bock unbenotced to me!. i was told by manderino that she imported him and paid a fortune LIE!!! i call the breeder and discused the pony . she too said he was a dressage pony. I informed ms manderino. when ms cadance came the most she could pay was 2500 and she really loved the pony. i explained i had a partner and woukd have to give her 25% of the sale!! I ALSO TOLD HER ABOUT HIS EYE AND HIS FULL HISTORY!she understood and agreed..I sold my 75% or 100% of my shares in the pony and informed manderino that I did so..I asked her if she wanted the 750 or to take of the monies she owed me from the payments of 25 dollars per baby from my stallion that i recieved no payment for,, SHE AGREED. I went to pony finals where I noticed my large not moving his tail at all and very lethergic! I asked her what was up she told me she gave him multiple nerve blocks in his tail to paralyse it !!!( Well that cant be good I thought ) almost midnight blackie went on to place at finals earning an overall ribbon yet I did not agree , or here about the abuse to his tail. At this time not one word of distress was told to me about the sale of dillianger. I saw her several times at final even buying her daughter a gift for working with blackie! if she was so upset dont you think she would have said some thing??anyway you could not sell a blind pony and I did not want mine sold with out informing the buyers
