Found and add for a boat that I was looking for,for sale by owner/ Dealer on Ebay. Sent a message and always got cocky replies so I asked for a time I could fly down and see the boat. Was told to give a deposit on the 2007 Stamas tarpon 340 because 2 other people were coming that weekend. They sent paperwork and I added pending inspection. Flew in to Ft. Lauderdale and met my mechanic along with my crew to transport the boat. Before leaving was told severe records were immaculate and boat was ready to go. 15 minutes into inspection mechanic alerted me to multiple engine issues in the computers history report. The engines were also so low on oil that it didn't register on the sticks. Then we tested electronics. Radar didn't work nor did a/c,refrigerator, microwave, shorepower,inverter or any else in the cabin as well as the bilge or back up bildge. I backed out. Also I found out that Neal was handling the sale bit Scott and his wife owned the boat. Scott said no problem and seemed to understand my frustration after traveling and planning out the transport of the boat. Later Neal called after I returned home and said the boat was ready. After telling him I didn't want it and that I had told Scott he said I would not get my $5,000.00 deposit back. I have gone back and forth for over a month and am considering suing autospecialists,neal,Scott and his wife. For false advertising, my deposit and all my expenses related to it in Louisiana and Florida since it was Falsely advertised and business was conducted across state lines.
This company Florida Auction Direct listed by the State of Florida to be located at 2512 SW 30 Avenue Pembroke Park, FL 33009 and owned by Celeste Daiagi and now listed as Auto Specialists of Florida2200 N 30th Rd, Hollywood FL. 33021 employs Neil Marcellino https://www.google.com/search?q=neil+marcellino&sourceid=ie7&rls=com.microsoft:en-US:IE-Address&ie=&oe= who has refused to return a deposit of $500.00 on a vehicle my son sent in good faith only after Ernie (last name unknown because Marcellino refused to tell us) his salesman on 2 inquiries prior to submitting deposit confirmed the company's commitment to hold vehicle for 1 day.Subsequent conversations with Marcellino confirmed that he would in fact refund my son's $500.00 deposit.
Below is the short version of the well documented events that unfolded.
My sons first time ever buying a vehicle. Prior to clicking on the EBay ""Buy It Now Option”, my son and I contacted the salesmen who only identified himself only as Ernie(?), Ernie said "" he would hold the car and refund the deposit if we were not able to have our local mechanic evaluate the vehicle. Ernie clearly stated that this was appropriate and if we could not arrange to have the vehicle inspected by our mechanic with in the following day he would refund the my son's $500.00 deposit. We then and only then sent the deposit.
We were unable to make arrangement for our chosen (trusted) mechanic to do the inspection. As a result we notified Ernie and he then refereed us to Neil Marcellino (who claimed to be the owner) and after 2 separate discussion Neil Marcellino agreed on both occasions that he would refund the deposit.
After a couple of days we did not see any refund posted. Once again Marcellino was contacted and he said on the afternoon of 2/14/2014 that he would complete the refund the following Monday 2/17/2014. He quoted “ as soon as he had his morning coffee he would take care of the refund”. After a few hours we once again contacted Marcellino to confirm that the refunded of $500.00 he had committed to do on 2/14/2014 had been completed. It was during this call that Marcellino refused to do the refund stating that it was now his money and was not about to refund it.
Through out the numerous conversations with Marcellino he had to be reminded that we would not have even considered placing a deposit on the vehicle if his employee Earnie (last name still unknown due to Marcellino refusing to tell us. In fact when Marcellino was asked to tell us his last name he also refused) had not clearly stated that a short hold would be acceptable and a refund allowed prior to us sending deposit money. His employee Ernie lied to us and Marcellino also lied to us. Neil Marcellino has clearly reneged on his commitment and his employee's commitment. Once I was able to find out Marcellino name a Google search along with a search of State records confirmed that Marcellino was not to be trusted.
Continued search of the internet shows that Neil Marcellio is a convicted felon for selling stolen property along with many other less than reputable activities in various endeavors. Had I know of Marcellino past I would have never considered doing any business with this company. He has conveniently hid himself behind Celeste Daiagi, Robert Garcia and this Ernie guy.
These guys are real good at stealing. I found an excavator in August through ebay from their company and was told by Neil Marcellino, Robert Garcia and Ernie to send a refundable $1,000.00 and the machine would be taken off the website until financing was found. Well, while getting financing approved I was later told that the machine sold and my refund would be sent out by Ernie at the end of business. Now a month later I am being told that account payable is in charge of the refunds. As of 11/1/2016 I was told Neil Marcellino handle the refunds. After several unanswered phone calls, I am now being told that the refund that I was due has been changed to non refundable which was not stated on their website. 11/17/2016 website is now under construction if that isn't believable. I am filing a civil suit against all parties that promised me that my deposit was refundable and I am filing a lien against Florida Auction Direct LLC and Auto Specialists of Florida LLC. I would advice anyone and everyone to stay away from this company and these guys.
