Aspire Resources took over my federal student loan in 2013. I have made payments on time and never missed any payments since I began paying back my federal student loans in 2010 when I graduated college. All my payments are automatic and post on the 15th of each month. My monthly automatic payment is $230.00. On the 16th of September 2014 Aspire Resources, Inc. debited $3,120.00 out of my checking account which immediately put my acccount on hold and in the negative. I contacted Aspire Resources the next day (17th of September) and inquired about what happened. The advisor I spoke with was very confused why the payment had processed in the excessive amount and not the normal $230.00. She said that she would put in a claim and they would investigate the reason and contact me back within 24 hours (I never recieved any phone call back!!). I told her I needed the money put back into my account and she said it could take up to 20 days!! I told her I couldn't wait 20 days because my account was negative due to the excessive debit they took out of my checking account. The advisor then told me that she would immediately terminate the automatic payment plan and for me to contact my bank to have the payment reversed. I was assured by the advisor that Aspire Resources would not be able to take any more funds automatically without my consent from then on. I contacted Wells Fargo and the payment was reversed, unfortunately with a NSF fee. Wells Fargo graciously reversed the NSF fee. 2 days later on the 19th of September, a Friday, I again was informed via email from Wells Fargo that my checking account was again negative due to a payment posting to Aspire Resources in the same amount before of $3,120.00!! Becuase it was late Friday when I found this out, Aspire Resources was closed and so was Wells Fargo's Claim Center. I was traveling at the time and consequently stranded without any means of getting gas or food from Friday night to Monday morning (over 60 hours!!). Wells Fargo again reversed the payment on Monday morning. I contacted Aspire Resources again Tuesday and spoke with a different advisor who informed me that they were not able to determine at that time why the first payment processed on the 16th of September. I then informed her that another payment posted in the same amount on Friday the 19th of September which consequently left me stranded due to insufficient funds in my checking account. The advisor was again confused and did not see where that payment had even been processed. I then told the advisor to get me on the phone with her manager. She told me that I couldnt speak with a manager but she would have her supervisor contact me. The next day I was contacted by another representative of Aspire Resources who informed me that there was still no explanation for the excessive payment on the 16th and that they were unaware that a second payment had been processed. I told her to contact Wells Fargo to confirm and she refused to cooperate. I then informed her that I would be looking into legal action since no explanation can be given to me. I informed her that from my standpoint this is a legal matter in which an illegal transaction was processed from my account by Aspire Resources. I also requested a settlement agreement be considered in the amount of $800.00 due to the grievences caused by the insufficient funds over the weekend. The representative said it would not be possible for any settlement to be accepted! We as consumers must hold creditors fully responsible for unauthorized and illegal transactions and must not be silent when incidents such as these occur. If Aspire Resources publically accepts fault and apologizes for the inconvienience, I will be willing to accept a lower settlement amount. If not, legal action will be persued.
